Inducement to Lender. The representations and warranties contained in the Loan Documents are made by Borrower as an inducement to Lender to make the Loan and Borrower understands that Lender is relying on such representations and warranties and that such representations and warranties shall survive any bankruptcy proceedings involving Borrower or the Premises.

Inducement to Lender. The representations and warranties contained in this Loan Agreement and the other Loan Documents (i) are made to induce Lender to make the Loan and extend any other credit to or for the account of Borrower pursuant hereto, and Lender is relying thereon and will continue to rely thereon, and (ii) shall survive the execution and delivery of this Loan Agreement and any bankruptcy proceedings involving Borrower, or any Property, foreclosure, or conveyance in lieu of foreclosure.

Acceptance of each Advance constitutes reaffirmation, as of the date of such acceptance, of the repre sentations, warranties, covenants and agreements of Borrower in the Loan Instruments except as disclosed in the Affidavit of Borrower (if accepted by Lender), on which Lender shall rely in making such Advance.
