INDEPENDENT MEDICAL JUDGMENT Sample Clauses

INDEPENDENT MEDICAL JUDGMENT. Notwithstanding anything to the contrary contained in this Agreement or in the SignatureMD Agreement, Concierge Practice retains full and free discretion to, and shall, exercise his/her professional medical judgment on behalf of Program Member with respect to medical services rendered to Program Member, and nothing in this Agreement shall be deemed or construed to influence, limit or affect a physician’s independent medical judgment with respect to Concierge Practice’s provision of medical services to Program Member and Program Member’s medical treatment.

INDEPENDENT MEDICAL JUDGMENT. Nothing in this Agreement, including, without limitation, the participation by PROVIDER, the PROVIDER physicians and PROVIDER non-physician providers in the Utilization Management Review and Quality Improvement Programs and other PLAN polices and programs is deemed to, or shall be construed to, interfere with or in any way affect the obligation of any PROVIDER physician and PROVIDER non-physician provider to exercise independent medical judgment in rendering all health care services to PROVIDER Medicare Members. PLAN does not direct, nor does it control the rendition of PROVIDER physicians’ or PROVIDER non-physicians’ medical services or their exercise of independent medical judgment.

INDEPENDENT MEDICAL JUDGMENT. Notwithstanding anything to the contrary contained in this Agreement or in the SignatureMD Agreement, Physician retains full and free discretion to, and shall, exercise his/her professional medical judgment on behalf of Program Member with respect to medical services rendered to Program Member, and nothing in this Agreement shall be deemed or construed to influence, limit or affect the Physician’s independent medical judgment with respect to Physician’s provision of medical services to Program Member and Program Member’s medical treatment.

INDEPENDENT MEDICAL JUDGMENT. Notwithstanding anything to the contrary contained in this Agreement or in the SignatureMD Agreement, Enhanced Cardiac Care Practice retains full and free discretion to, and shall, exercise his/her professional medical judgment on behalf of Program Member with respect to medical services rendered to Program Member, and nothing in this Agreement shall be deemed or construed to influence, limit or affect a physician’s independent medical judgment with respect to Enhanced Cardiac Care Practice’s provision of medical services to Program Member and Program Member’s medical treatment.

INDEPENDENT MEDICAL JUDGMENT. Your Physician retains full and free discretion to exercise his professional medical judgment on your behalf and nothing in this Agreement shall be deemed or construed to influence or affect your Physician’s independent clinical judgment.

INDEPENDENT MEDICAL JUDGMENT. Customer and Optum both acknowledge and agree that Participants’ treating physician(s) and other health care providers, including but not limited to Network Providers, shall be solely responsible to provide treatment and/or services to Participants and to make all decisions related to patient care and shall exercise their independent medical judgment as to all such matters. Nothing in this Agreement shall be deemed to create any rights of Optum, Customer, or any other person or entity to intervene in any manner with or otherwise interfere with the independent medical judgment of Participants’ health care providers with regard to treatment or utilization issues, nor shall it render Optum, Customer, or any other person or entity responsible for the method or means by which any health care provider renders treatment or service to a Participant.

INDEPENDENT MEDICAL JUDGMENT. Physician shall make any and all decisions pertaining or related to the practice of medicine and the care and treatment of patients. Notwithstanding any provision hereof to the contrary, including but not limited to Section 2(b), Physician shall perform all services with respect to the diagnosis and treatment of patients in such manner as Physician, in the independent exercise of Physician’s independent medical judgment, deems to be in the best interests of the patients. The parties specifically agree and acknowledge that Physician shall have full and final authority over all medical decisions made in the course of Physician’s rendering care and treatment to patients at the Centers.

INDEPENDENT MEDICAL JUDGMENT. ▇▇▇▇▇ Health and its Physician or Professionals shall use their independent medical and professional judgment when performing professional telehealth services. ▇▇▇▇▇, nor the Charter Organization, shall have nor exercise any control over the professional judgment and medical decision-making of the Physicians or Professionals.

INDEPENDENT MEDICAL JUDGMENT. BPC Providers shall retain full discretion to exercise their professional medical judgment on behalf of Patient. Nothing in this Agreement shall be deemed or construed to influence or affect the BPC Provider’s independent medical judgment on behalf of a Patient.
