Independent Contractor's Obligations. Independent Contractor shall incur no further obligations in connection with the terminated work and on the date set in the notice of termination Independent Contractor will stop work to the extent specified. Independent Contractor shall also terminate out­standing orders and subcontracts as they relate to the terminated work. Independent Contractor shall settle the liabilities and claims arising out of the termination of subcontracts and orders connected with the terminated work. The Commissioner or designee may direct Independent Contractor to assign Independent Contractor’s right, title, and interest under terminated orders or subcontracts to the State. Independent Contractor must still complete the work not terminated by the notice of termination and may incur obligations as are necessary to do so.
Independent Contractor's Obligations. (a) Independent Contractor shall furnish Carrier with current driver qualification data as required by the provisions of the Federal Motor Carrier Safety Administration {the "FMCSA," formerly the Interstate Commerce Commission), the Department of Transportation ("DOT'), the Public Service Commission of the various states and other applicable federal and state authorities, including DOT qualification data, evidence of current physical examinations, appropriate licenses, complete driving history, and other relevant material. Independent Contractor acknowledges that failure to maintain current qualification data on file with Carrier or failure to accept any vehicle (or load) or to file a formal status report with Carrier's dispatch center within thirty (30) days may result in a requirement for re-qualification as to any subsequent load. (b) Independent Contractor shall direct and transport the motor vehicle described on the bill of lading from point of origin to point of destination utilizing such routes and methods as are authorized by appropriate federal and state authorities. Independent Contractor shall determine the methods, means and manner of performing this contract (including time of travel, lawful routes, servicing of vehicle, etc.); provided, however, that Independent Contractor shall be subject to the reasonable rules and regulations regarding dispatch established by Carrier in order to comply with the Customer's specific needs. It is expressly agreed that Independent Contractor is free to accept or reject assignments from Carrier. (c) Independent Contractor shall promptly and expeditiously transport and deliver the vehicle described in the bill of lading; collect in full ail sums due from consignee and to hold said funds secure for Carrier; notify the dispatch office immediately of any problems or delays in route; return transporter plates and all pertinent documents before contract proceeds shall be deemed earned and due to Independent Contractor; be fully responsible for all losses to motor vehicles contracted for transport by Independent Contractor resulting, directly or indirectly, from any act or omission of Independent Contractor until such time as the transported vehicle(s) is delivered to the consignee at the place designated in the bill of lading and a delivery receipt, duly sigried, is obtained from an authorized representative of the consignee; refrain from permitting any individual not approved in writing by Carrier to operate control...
