Common use of Independent Contractor Clause in Contracts

Independent Contractor. In the performance of its services hereunder, the Subadviser is and shall be an independent contractor and unless otherwise expressly provided herein or otherwise authorized in writing, shall have no authority to act for or represent the Fund, the Trust or the Adviser in any way or otherwise be deemed an agent of the Fund, the Trust or the Adviser.

Independent Contractor. In the performance of its services duties hereunder, the Subadviser Sub-Advisor is and shall be an independent contractor and and, unless otherwise expressly provided herein or otherwise authorized in writing, shall have no authority to act for or represent the a Fund, the Trust or the Adviser Advisor in any way or otherwise be deemed an agent of the a Fund, the Trust or the AdviserAdvisor.

Independent Contractor. In the performance of its services hereunder, the The Subadviser is and shall for all purposes herein be deemed to be an independent contractor and shall, unless otherwise expressly provided herein or authorized by the Investment Adviser from time to time, have no authority to act for or represent the Investment Adviser in any way or otherwise be deemed its agent. Independent Contractor. In the performance of its services duties hereunder, the Subadviser SubAdviser is and shall be an independent contractor and unless otherwise expressly provided herein or otherwise authorized in writing, shall have no authority to act for or represent the Fund, the Trust Fund or the Adviser in any way or otherwise be deemed an agent of the Fund, the Trust Fund or the Adviser.

Independent Contractor. In Notwithstanding anything herein to the performance of its services hereundercontrary, the Subadviser is and Subadvisor shall be an independent contractor and unless otherwise expressly provided herein or otherwise authorized in writing, shall will have no authority to act for or represent the FundTrust, the Trust Fund or the Adviser Manager in any way or otherwise be deemed an agent of any of them, except to the Fund, extent expressly authorized by this Agreement or in writing by the Trust or the AdviserManager.

In the performance of its services duties hereunder, the Subadviser is and shall be an independent contractor and unless otherwise and, except as expressly provided herein or otherwise authorized in writing, shall have no authority to act for or represent the FundTrust, the Funds, any other series of the Trust or the Adviser Manager in any way or otherwise be deemed to be an agent of the FundTrust, the Funds, any other series of the Trust or the AdviserManager.

Independent Contractor. In the performance of its services hereunder, the Subadviser is and shall be an independent contractor and unless otherwise expressly provided herein or otherwise authorized in writing, shall have no authority to act for or represent the Fund, the Trust or the Adviser in any way or otherwise be deemed an agent of the Fund, the Trust or the Adviser.. In the performance of its services the Subadvisor’s duties hereunder, the Subadviser Subadvisor is and shall be an independent contractor and unless except as otherwise expressly provided herein or otherwise authorized in writing, shall have no authority to act for or represent the FundTrust, the Trust Fund or the Adviser Manager in any way or otherwise deemed to be deemed an agent of the FundTrust, the Trust Fund or the AdviserManager.

Independent Contractor. In the performance of its services duties hereunder, the Subadviser Subadvisor is and shall be an independent contractor and unless otherwise expressly provided herein or otherwise authorized in writing, shall have no authority to act for or represent the Fund, the Trust Fund or the Adviser Advisor in any way or otherwise be deemed an agent of the Fund, the Trust Fund or the AdviserAdvisor.

In the performance of its services duties hereunder, the Subadviser Sub- Advisor is and shall be an independent contractor and and, unless otherwise expressly provided herein or otherwise authorized in writing, shall have no authority to act for or represent the a Fund, the Trust or the Adviser Advisor in any way or otherwise be deemed an agent of the a Fund, the Trust or the AdviserAdvisor.
