Common use of Incentive Stock Option Clause in Contracts

Incentive Stock Option. The Option is intended to satisfy the requirements applicable to an “incentive stock option” described in Code Section 422(b) (an “ISO”). If the Option, in whole or in part, fails for any reason to satisfy the requirements applicable to an ISO, then the Option, or that portion which fails to satisfy the requirements applicable to an ISO, shall be treated as a nonqualified stock option.

Incentive Stock Option. The This Option is intended to satisfy the requirements applicable to qualify as an “incentive stock option” described option (an ISO as defined in Code the Plan) within the meaning of Section 422(b) (an “ISO”)of the Code, and the provisions hereof shall be construed consistent with that intent. If this Option fails or ceases to qualify as an incentive stock option within the Optionmeaning of Section 422(b) of the Code, it shall continue in whole or in part, fails for any reason to satisfy the requirements applicable to an ISO, then the Option, or that portion which fails to satisfy the requirements applicable to an ISO, shall be treated effect as a nonqualified stock optionNon-qualified Stock Option.
