Inaccurate Data. By using the HIE and the Services, each Participant acknowledges that all data to which access is made through the HIE and/or the Services originates from Data Sources and does not originate from HEALTHeLINK. All such data is subject to change arising from numerous factors, including without limitation, changes to patient health information made at the request of the patient, changes in the patient’s health condition, the passage of time and other factors. HEALTHeLINK neither initiates the transmission of any data nor monitors the specific content of data being transmitted. Without limiting any other provision of these Terms and Conditions, HEALTHeLINK SHALL HAVE NO RESPONSIBILITY FOR OR LIABILITY RELATED TO THE ACCURACY, CONTENT, CURRENCY, COMPLETENESS, CONTENT, OR DELIVERY OF ANY DATA EITHER PROVIDED BY A DATA SOURCE, OR USED BY A DATA RECIPIENT, PURSUANT TO THESE TERMS AND CONDITIONS, except to the extent that the content of such information is distorted or corrupted as a direct result of the negligent acts or omissions or willful misconduct of HEALTHeLINK.

All data to which access is made through the System and/or the Services originates from Data Providers and other parties making data available through one (1) or more Other Health Information Sharing Programs, and not from HIO. All such data is subject to change arising from numerous factors, including without limitation, changes to patient health information made at the request of the patient, changes in the patient’s health condition, the passage of time and other factors. HIO neither initiates the transmission of any data nor monitors the specific content of data being transmitted. Without limiting any other provision of the Terms and Conditions, HIO shall have no responsibility for or liability related to the accuracy, content, currency, completeness, content, or delivery of any data either provided by a Data Provider, or used by a Data Recipient, pursuant to the Terms and Conditions.

All Patient Data to which access is made through the Hosted System or the Hosted Applications originates initially from Participants and is subject to change arising from numerous factors, including without limitation, changes to patient health information made at the request of the patient, changes in the patients health condition, the passage of time and other factors. The NDHIN does not monitor the specific content of data being transmitted. Without limiting any provision of the NDHIN Policies and Procedures, the NDHIN has no responsibility for or liability related to the accuracy, content, currency, completeness, content or delivery of any data either provided or used by a Participant, pursuant to the NDHIN Policies and Procedures, except to the extent that the content of this information is distorted or corrupted as a result of the negligent actions or omissions or willful misconduct of the NDHIN.

Without limiting any other provision of this Agreement, Redwood MedNet shall have no responsibility for or liability related to the accuracy, content, currency, completeness, content, or delivery of any data either provided by a Data Provider, or used by a Data Recipient.

HEALTHeLINK neither initiates the transmission of any data nor monitors the specific content of data being transmitted. Without limiting any other provision of the Policies and Procedures, HEALTHeLINK shall have no responsibility for or liability related to the accuracy, content, currency, completeness, or delivery of any data either provided by a Data Provider, or used by a Data Recipient, pursuant to this Agreement or the Policies and Procedures, except to the extent negligent acts or omissions of HEALTHeLINK result in HEALTHeLINK failing to correctly format or display information to Data Recipients as it was received by HEALTHeLINK from Data Providers.

All such data is subject to change arising from numerous factors, including without limitation, changes to patient health information made at the request of the patient, changes in the patient’s health condition, the passage of time and other factors. The RHIO neither initiates the transmission of any data nor monitors the specific content of data being transmitted. Without limiting any other provision of the SHIN-NY Policy Standards and the RHIO Policies and Procedures, the RHIO shall have no responsibility for or liability related to the accuracy, content, currency, completeness, content or delivery of any data either provided or used by Participant, pursuant to the SHIN-NY Policy Standards and the RHIO Policies and Procedures, except to the extent that the content of such information is distorted or corrupted as a result of the negligent actions or omissions or willful misconduct of the RHIO.
Inaccurate Data. If any meter data provided to the Distributor is found to be inaccurate, the Distributor reserves the right to decide whether to use that data or to make appropriate adjustments to the data.

All data to which access is made through the Network and/or the Services originating from Members, and not from IHS (except when IHS also acts as a Member) is subject to change arising from numerous factors, including without limitation, changes to PHI made at the request of the Individual, changes in the Individual’s health condition, the passage of time and other factors.
