Employees who have accumulated one hundred (100) sick leave days prior to any given year will be able to use up to three (3) of these days, under the same provisions as personal days with appropriate notice to and approval of the Board or its designee. 2. The Board shall maintain records of all sick days. On or before the first pay period in October, the Board shall provide a written statement to each teacher of his/her number of accumulated sick days and any unused personal leave days earned through the last school day of June of the previous school year. In the event legislation allows the application of sick day accumulation toward retirement, all days shall be made applicable for retirement purposes including those beyond two hundred twenty (220). 3. Upon the termination of services with the school district, teachers with more than twenty (20) days accumulated shall be paid for all unused days beyond the twenty (20) to a maximum pay out for two hundred (200) days. The rate of pay shall be sixty dollars ($60.00) per day. 4. A sick leave bank shall be maintained by the Association. Days are to be accumulated from one year to the next. Each new teacher shall contribute one sick day. If the number of days in the common bank is below two-thirds (2/3) of the number of teachers contributing to the leave bank, then each teacher shall contribute one (1) day from their sick leave allowance. If neither of the above positions are available, the teacher will be granted permanent substitute status. The employee will be compensated at the rate of $100.00 daily with full health, vision, and dental benefits. The employee will accrue seniority and receive prorated sick and personal leave days. 7. Upon the recommendation of the Superintendent, the Board may, at the Board's expense, require a teacher to submit to a mental or physical examination by appropriate specialists to determine whether involuntary sick leave is warranted. If the report of the Board's doctor and the report of the employee's doctor are in disagreement or conflict, the controversy shall bypass the grievance procedure and, instead, the affected employee shall be examined at Board expense by an appropriate specialist in the area of controversy at St. John's Hospital, ▇▇▇▇▇ ▇▇▇▇ Hospital, or at the University of Michigan Medical Center at ▇▇▇ Arbor. This final determination shall be binding on the parties. Any teacher so placed on sick leave of absence shall have the right to a hearing in accordance with the Tenure Law. Any teacher, whose personal illness extend beyond the period compensated, will be granted a leave of absence without pay or increment for such time as is necessary for complete recovery. Return from leave shall be in accordance with the procedure in Article XI, Section A., #5 and #6. 8. Any teacher who is absent because of an injury or disease compensable under the Michigan Workers' Compensation Law may use accrued sick days to supplement workers compensation pay to bring them to their full contractual amount. In such case, accrued sick leave may be used in increments of less than a half day as needed. 9. Family and Medical Leave Act (FMLA) The Board will grant up to twelve (12) weeks of family and medical leave during any twelve (12) month period to eligible employees in accordance with the Family Medical Leave Act of 1993 (FMLA). All requests for such leave will be made to the Superintendent or designee. When the need is foreseeable, such notice will be given thirty (30) days before the start of the FMLA leave. If it is not possible for the employee to give thirty (30) days notice, the employee will give as much notice as practicable. Proper certification of the reason for the leave must be provided. Teachers will receive all rights and benefits for the duration of the leave including the accrual of seniority. All child care leaves allowable under the Family Medical Leave Act (FMLA) will be unpaid.
