Common use of Household Size Clause in Contracts

Household Size. Tenant understands that the Landlord will assign the units according to the size of the household in accordance with New York State Division of Housing and Community Renewal requirements of no more than two persons per bedroom and no more than two persons for a zero-bedroom unit. The Landlord must offer the tenant from among available units in the development a lease for a unit of appropriate size if a tenant's household size increases or decreases so that it is not within these guidelines. Except as otherwise prohibited by law, tenant's refusal to move into a unit of appropriate size when requested to do so would constitute good cause for termination of the lease and tenant agrees to vacate the unit if requested to do so by the Landlord.
