Hospice represents and warrants a) Neither Hospice nor, to the best of its knowledge, its employees or agents, are or ever have been excluded from participation in the Medicare or Medicaid programs.
b) Neither Hospice nor, to the best of its knowledge, its employees or agents, have been convicted of a health care-related criminal offense.
c) Hospice will notify Hospital/Facility within 5 working days of receipt of any final adverse action taken against the Hospital/Facility or against a contractor that involves a health care fraud or abuse issue.
d) Hospice will comply with Hospital/Facility’s Code of Conduct and Compliance Program, to the extent that the Hospital/Facility communicates the applicable policies and procedures to Hospice.
