Common use of Historical Performance Information Clause in Contracts

Historical Performance Information. To the extent agreed upon by the parties, the Sub-SubAdviser will provide the Fund and the SubAdviser with historical performance, fee and expense information about the composite of accounts and investment companies the Sub- SubAdviser manages that have investment objectives, policies, and strategies substantially similar to those employed by the Sub-SubAdviser in managing the Allocated Assets, to be included in the Prospectus or for any other uses permitted by applicable law or to permit the Adviser and SubAdviser to satisfy their supervision and oversight responsibilities as required under applicable law.
