HIPAA Business Associate. 14.1 If Customer is a “covered entity” or a “business associate” and includes “protected health information” (as those terms are defined in 45 CFR § 160.103) in Customer Data, the HIPAA Business Associate Agreement attached hereto as Schedule 2 of this DPA is incorporated by reference into this DPA and the Agreement, as appropriate.
HIPAA Business Associate. Accretive shall execute contemporaneously with this MSA the Business Associate Agreement attached hereto as Exhibit 2. Furthermore, Accretive agrees to amend the Business Associate Agreement as reasonably requested by Ascension Health for purposes of continued compliance by Ascension Health and Affiliates with the Health Insurance Portability and Accountability Act of 1996 and the regulations promulgated thereunder.
HIPAA Business Associate. If Customer is a “covered entity” or a “business associate” and includes "protected health information" in Customer Data as those terms are defined in 45 CFR § 160.103, execution of the Agreement includes execution of the Motorola HIPAA Business Associate Agreement Addendum (“BAA”). Customer may opt out of the BAA by sending the following information to Motorola in a written notice under the terms of the Customer’s Agreement.
HIPAA Business Associate. General Provisions The Parties agree that the terms used, but not otherwise defined, in this Section to the Contract shall have the same meaning as those terms in the Standards for Privacy of Individually Identifiable Health Information, 45 Code of Federal Regulations (CFR), Parts 160 and 164, otherwise known as the Health Insurance Portability and Accountability Act (HIPAA) Privacy Rule, as it may exist now or be hereafter amended. It is agreed by both Parties that Contractor is a Business Associate of County for the purposes of this Contract. It is understood by both Parties that the Privacy Rule does not pre-empt any State and/or Federal laws, rules or regulations that impose more stringent requirements with respect to confidentiality of client information.
HIPAA Business Associate. The Plan Supervisor acknowledges its role as a business associate for purposes of the privacy and security standards under HIPAA.
HIPAA Business Associate. If Customer is a “covered entity” or a “business associate” and includes "protected health information" in Customer Data as those terms are defined in 45 CFR § 160.103, execution of the MCA includes execution of the Motorola HIPAA Business Associate Agreement Addendum (“BAA”). Customer may opt out of the BAA by sending the following information to Motorola in a written notice under the terms of the Customer’s Agreement: “Customer and Motorola agree that no Business Associate Agreement is required. Motorola is not a Business Associate of Customer’s, and Customer agrees that it will not share or provide access to Protected Health Information to Motorola or Motorola’s subprocessors.”

  • HIPAA To the extent (if any) that DXC discloses “Protected Health Information” or “PHI” as defined in the HIPAA Privacy and Security Rules (45 CFR, Part 160-164) issued pursuant to the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) to Supplier or Supplier accesses, maintains, uses, or discloses PHI in connection with the performance of Services or functions under this Agreement, Supplier will: (a) not use or further disclose PHI other than as permitted or required by this Agreement or as required by law; (b) use appropriate safeguards to prevent use or disclosure of PHI other than as provided for by this Agreement, including implementing requirements of the HIPAA Security Rule with regard to electronic PHI; (c) report to DXC any use or disclosure of PHI not provided for under this Agreement of which Supplier becomes aware, including breaches of unsecured protected health information as required by 45 CFR §164.410, (d) in accordance with 45 CFR §164.502(e)(1)(ii), ensure that any subcontractors or agents of Supplier that create, receive, maintain, or transmit PHI created, received, maintained or transmitted by Supplier on DXC’s behalf, agree to the same restrictions and conditions that apply to Supplier with respect of such PHI; (e) make available PHI in a Designated Record Set (if any is maintained by Supplier) in accordance with 45 CFR section 164.524;
