Higher Duties Payment. a) An employee who is called upon to perform work at a Level above their current classified Level for a period of more than one day, will be paid at the minimum rate prescribed for that higher Level for the whole period involved on such higher Level duties. b) Where higher duties are available due to the temporary absence of the person who usually holds that position, all things being equal, preference shall be given to permanent staff over casual staff to undertake the higher duties. Staff who are performing higher duties will be paid at the first pay point (increment) of the classification level of the position being temporarily filled, except in circumstances where an employee has previously relieved at that classification level, in which case, all previous service at that level will be recognised for the purposes of determining the increment level. At the time the offer to work the higher level duties is made, the employer shall confirm the level and pay rate that will be applicable for the duration that the employee works the higher duties. The higher duties are to be accepted or declined at the employee’s discretion and a written record shall be kept at the workplace by the employer. Where an offer to work higher duties extends beyond 12 weeks, a new temporary contract is to be formalised and agreed between the employer and employee. At the expiration of the temporary contract, the employee shall revert back to their previous employment contract unless otherwise agreed.
