High Risk Applications. Customer may not use, or authorize others to use, any part of any Offering in any application in which the failure of the Offering could lead to death, personal injury or severe physical or property damage ("High-Risk Applications"), including the monitoring, operation or control of nuclear facilities, mass transit systems, aircraft navigation or aircraft communication systems, air traffic control, weapon systems and direct life support machines. Entrust expressly disclaims any express or implied warranty of fitness for High Risk Applications.
High Risk Applications. Unless Tridium has provided its express written consent for each component of the License Software, you will make reasonable business efforts to ensure that it is not used in any application in which the failure of the Licensed Software could lead to death, personal injury or severe physical or property damage, including, without limitation, environmental damage, (collectively, "High-Risk Applications"), including but not limited to the operation of nuclear facilities, mass transit systems, aircraft navigation or aircraft communication systems, air traffic control, weapon systems and direct life support machines. Tridium expressly disclaims any express or implied warranty or condition of fitness for High-Risk Applications.
High Risk Applications. Products sold by Cypress are not designed, intended, or authorized for use as critical components in systems designed or intended for the operation of weapons, weapons systems, nuclear installations, life-support devices or systems, other medical devices or systems (including resuscitation equipment and surgical implants), pollution control or hazardous substances management (“Unintended Uses”). A critical component is any component of a device or system whose failure to perform can be reasonably expected to cause the failure of the device or system, or to affect its safety or effectiveness. Cypress is not liable, in whole or in part, and Company shall release Cypress from any claim, damage, or other liability arising from all Unintended Uses of Product. Company shall indemnify and hold Cypress harmless from and against all claims, costs, damages, and expenses, arising out of any claim, including claims for personal injury or death, arising from any Unintended Uses of Products.
High Risk Applications. You will make reasonable business efforts to ensure that the Software is not used in any application in which the failure of the Software could lead to death, personal injury or severe physical or property damage, including, without limitation, environmental damage, (collectively, "High-Risk Applications"), including but not limited to the operation of nuclear facilities, mass transit systems, aircraft navigation or aircraft communication systems, air traffic control, weapon systems and direct life support machines, unless otherwise permitted by SKYFOUNDRY in writing. Without limiting any disclaimer of any express or implied warranty under this Agreement, SKYFOUNDRY expressly disclaims any express or implied warranty or condition of fitness of the Software for High-Risk Applications.
High Risk Applications. THE SERVICE IS NOT DESIGNED, MANUFACTURED, OR INTENDED FOR USE WITH DATA, CONTENT OR INFORMATION USED FOR OR REQUIRING FAIL-SAFE PERFORMANCE, SUCH AS IN THE OPERATION OF NUCLEAR FACILITIES, AIRCRAFT NAVIGATION OR COMMUNICATION SYSTEMS, AIR TRAFFIC CONTROL, DIRECT LIFE SUPPORT MACHINES, OR WEAPON SYSTEMS, IN WHICH THE FAILURE OF THE PRODUCT COULD LEAD DIRECTLY TO DEATH, PERSONAL INJURY, OR SEVERE PHYSICAL OR ENVIRONMENTAL DAMAGE ("HIGH RISK APPLICATIONS"). VENDOR AND ITS SUPPLIERS SPECIFICALLY DISCLAIM ANY EXPRESS OR IMPLIED WARRANTY OF FITNESS FOR HIGH RISK APPLICATIONS.
High Risk Applications. Licensee acknowledges and agrees that: (i) the QNX Materials are offered as a general purpose, modular, real-time operating system; (ii) there will be errors (which may include critical errors) in the QNX Materials; (iii) selecting and integrating modules of the QNX Materials into a runtime Target System environment requires many design decisions which impact the operation, performance and reliability of the Target System; (iv) the operation, performance and reliability of the QNX Materials in the Target System may also be affected by error corrections or enhancements, and by changes to the associated hardware or software environments; (v) error corrections may not be subjected to the same level of quality assurance testing to which QSS subjects its commercially released software products; (vi) Licensees who engage in high risk applications must conduct thorough testing to identify and correct problems prior to the release of Target Systems, and prior to the release of any modifications, updates or enhancements thereto; (vii) such testing requires an intimate knowledge of the overall Target System design, and the nature and scope of ongoing changes; and (viii) QSS has minimal experience in or knowledge of the risks associated with Licensee’s direct and indirect use of the Target System, and has no control over Licensee’s testing programs or decisions to release Target Systems.
High Risk Applications. To the extent LICENSEE elects to use one (1) or more contents of a PKLA Product Kit in any products or services that are used in applications or environments requiring fail-safe performance in which the failure or malfunction of any of the contents of a PKLA Product Kit could lead to death, personal injury, or severe physical or property damage, LICENSEE hereby acknowledges and agrees that (a) LICENSEE shall assume all risk and liabilities associated with such uses, (b) LICENSEE shall indemnify, defend and hold QTIL and its Affiliates, harmless from and against any and all losses, claims, damages, actions, suits, proceedings, demands, assessments, adjustments, liabilities, costs and expenses arising as a result of such uses, and (c) LICENSEE shall be solely responsible to ensure its compliance with any and all applicable federal, state, and local statutes, laws, regulations, and guidelines, including Federal Aviation Administration (FAA) restrictions or warnings, in connection with such uses.
High Risk Applications. C3 AI Materials are not intended for use in, and You agree the C3 Materials will not be used in, the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control systems, life support machines, or other equipment or applications in which the failure thereof could lead to death, personal injury, or severe physical or environmental damage. Any product warranties for the C3 AI Materials under this Agreement shall exclude the applications and devices set forth in this Section. We disclaim any and all liability arising out of, or related to, any such use of the C3 AI Materials.
High Risk Applications. The Licensed Technology is not designed or warranted for use with chips other than Components, and it and the Components are not warranted by us for use in developing, or for incorporation into, products or services used in applications or environments requiring fail-safe performance, such as in the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control, life support machines, surgically implanted devices, weapons systems, or other applications, devices or systems in which the failure of a Component or of Our Software or Your Software could lead directly to death, personal injury, or severe physical or environmental damage (“High Risk Activities”). Notwithstanding any other provision of this License, you may not use or permit any third party to use Our Software, Your Software or any Designated Equipment in connection with any High Risk Activity. You assume all risk of such uses, and if you or your customers at any tier use or permit the use of any such item(s) in connection with High Risk Activities, you agree to indemnify, defend and hold us harmless from all claims, expenses and liability arising as a result of such use.
