Health & Environment. 40.6 The Contractor shall give all notices and otherwise fully comply with all laws, statutes, regulations, ordinances, rules, standards, orders or determinations of any governmental authority (including related determinations, interpretations, orders or opinions of any judicial or administrative authority) which has jurisdiction over the Contractor and the performance of this Agreement pertaining to the protection or conservation of the air, land, human health, industrial hygiene or other aspects of the environment which are directly applicable to the performance of this Agreement.

Health & Environment. The Company, Union and Local Union ac- knowledge their common concern for maintaining a safe and healthy working environment. In order to effect a thoroughly understood and accepted safety, health and environment program for employ- ees at work it is agreed that joint and co-operative methods should be encouraged. To this end, joint safety, health and environment committees will be established for the Port Plant for the Operations coming within the Plant as set out in Schedule attached to this Agreement. In addition, the Union, the Executive of the Local Union and at the request of the Executive of the Local Union the General Safety, Health and Envi- ronment Committee of the Local Union shall have the right at any time to discuss matters dealing with safety, health and environment conditions affecting employees while at work. The Company shall continue to make provi- sions for the safety and health of its employees and shall continue its existing safety devices and prac- tices for the purposes of protecting employees from injury, accident and unhealthful conditions subject to such improvements or changes as may be by the Company from time to time. In mak- ing any changes affecting employees of the Plant with respect to either the Safety and Health Pro- gram, the Workplace Environment Program or a Personnel Protective Program, such changes will be discussed prior to their introduction at a meeting of the appropriate Operation Committee or the Plant Safety, Health and Environment Committee in or- der to give the Committee an opportunity to review the changes and make suggestions regarding possi- ble alternative arrangements or programs. The Union and the Local Union agree to co-operate with the Company in developing and maintaining a strong sense of safety awareness among employ- ees. In this connection, it is recognized that every employee has the right to report unsafe conditions and practices to his immediate supervisor. The Company undertakes to provide each Opera- tion Committee and the Plant Safety, Health and Environment Committee once a month with a daily and monthly summary of injuries for review and discussion by the Committees. The Company will also provide the Local Union on request with such summaries and with a list of employees who have applied for Workers’ Compensation benefits.
