HEALTH AND SAFETY OF EMPLOYEES. In accordance with RSMO 292.675 any contractor for any public body for purposes of construction of public works and any subcontractor to such contractor shall provide a ten-hour Occupational Safety and Health Administration (OSHA) construction safety program for their on-site employees which includes a course in construction safety and health approved by OSHA of a similar program which is at least as stringent as an approved OSHA program, unless such employees have previously completed the required program. All employees who have not previously completed the program are required to complete the program within sixty days of beginning work on such construction Project. Any employee found on a work site subject to this section without documentation of the successful completion of the course required shall be afforded twenty days to produce such documentation before being subject to removal from the Project. The CONTRACTOR will forfeit a penalty to the CITY of $2,500 plus an additional $100 for each employee employed by the contractor or subcontractor, or each calendar day, or portion thereof, such employee is employed without the required training.

HEALTH AND SAFETY OF EMPLOYEES. In accordance with the provisions of Section 292.675 RSMo any person signing a contract to work on the construction of public works for any public body shall provide a ten-hour Occupational Safety and Health Administration (OSHA) construction safety program for their on- site employees which includes a course in construction safety and health approved by OSHA or a similar program approved by the department which is at least as stringent as an approved OSHA program. All employees are required to complete the program within sixty days of beginning work on such construction project, unless such employees have previously completed the required program. Contractor acknowledges and agrees that any of Contractor’s employees found on the Project site without documentation of the successful completion of a construction safety program shall be required to produce such documentation within twenty (20) days, or will be subject to removal from the Project. Pursuant to Section 292.675, RSMo, Contractor shall forfeit to the Owner as a penalty two thousand five hundred dollars ($2,500.00), plus one hundred dollars ($100.00) for each on-site employee employed by Contractor or its Subcontractor, for each calendar day, or portion thereof, such on-site employee is employed without the construction safety training required above. The penalty described herein shall not begin to accrue until the time periods described above have elapsed. Violations of this section and any penalties imposed shall be investigated and determined by the Missouri Department of Labor and Industrial Relations.
HEALTH AND SAFETY OF EMPLOYEES. 6.1. The Contractor shall be solely responsible for the health and safety of its employees and subcontractor’s employees in connection with the services performed in accordance with this Contract. The Contractor shall maintain all required Health and Safety Plans, which shall meet all applicable laws, regulations, rules, standards, and ordinances. The Contractor shall ensure that all of the Contractor’s employees, including those of all subcontractors, have received all of the training and monitoring required to properly and safely perform Contract services. Such training and monitoring includes, but is not limited to, all applicable sections of the State and Federal Occupation, Safety and Health Administration (OSHA) laws, Superfund Amendments and Reauthorization Act (XXXX), Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), and Resource Conservation and Recovery Act (RCRA). Further, the Contractor shall provide all employees with necessary personal protective equipment, such as special clothing and head, respiratory, eye, hand and foot protection. At the request of the Contract Users, the Contractor shall provide copies of training records for staff that perform Contract Services.
