Grounds For The Appeal Clause Samples
Grounds For The Appeal. Per Colorado state statute and regulations promulgated by the Colorado Department of Education, the grounds for an appeal shall be limited to the following:
1. The evaluator did not follow rules, statute, or procedure per Policy 4170 and thatfailure to adhere to those requirements had a material impact on the final Performance Evaluation Rating that was assigned to the teacher (e.g., an observation was never completed); and/or
2. The data relied upon was inaccurately attributed to the Teacher.
Grounds For The Appeal. The appellant has the onus of showing that the grounds raised by the notice of appeal are established and further, that the existence of such grounds discloses that the decisions or recommendation made by the Vice-President (Academic) was contrary to the evidence presented, or manifestly unfair, to the appellant.
