Common use of Governmental Regulations Clause in Contracts

Governmental Regulations. Neither the Borrower nor any Subsidiary nor any corporation controlling the Borrower or any Subsidiary or under common control with the Borrower or any Subsidiary is subject to regulation under the Investment Company Act of 1940, as amended, or is subject to any statute or regulation which regulates the incurrence of Indebtedness.

Neither the Borrower Borrower, any of its Subsidiaries nor any Subsidiary nor any corporation controlling Person controlled by, controlling, or under common control with, the Borrower or any Subsidiary or under common control with the Borrower or any Subsidiary of its Subsidiaries, is subject to regulation under the Investment Company Act of 1940, as amended, or is subject to any statute or regulation which regulates prohibits or restricts the incurrence of Indebtedness.
