Common use of Governmental Access to Records Clause in Contracts

Governmental Access to Records. Business Associate shall make its internal practices, books and records relating to the use and disclosure of Protected Information available to Covered Entity and to the Secretary of the U.S. Department of Health and Human Services (the “Secretary”) for purposes of determining Business Associate s compliance with the Privacy Rule. Business Associate shall provide to Covered Entity a copy of any Protected Information that Business Associate provides to the Secretary concurrently with providing such Protected Information to the Secretary.

Business Associate shall make its internal practices, books books, and records relating to the use and disclosure of Protected Information available to Covered Entity and to the Secretary of the U.S. Department of Health and Human Services (the “Secretary”) for purposes of determining Business Associate s Associate’s compliance with the Privacy RuleRule [45 C.F.R. Section 165.504(e)(2)(ii)(I). Business Associate shall concurrently provide to Covered Entity a copy of any Protected Information internal practices, books, and records relating the use and disclosure of PHI that Business Associate provides to the Secretary concurrently with providing such Protected Information to the Secretary.

Business Associate shall make its internal practices, books and records relating to the use and disclosure of Protected Health Information available to received from, or created or received by Business Associate on behalf of, Covered Entity and available to the Secretary and, at the request of the U.S. Department of Health and Human Services (the “Secretary”) Covered Entity, to Covered Entity, for purposes of the Secretary determining Business Associate s Covered Entity’s compliance with the Privacy Rule and the Security Rule. Business Associate shall provide to Covered Entity a copy of any Protected Information that Business Associate provides to the Secretary concurrently with providing such Protected Information to the Secretary.

Business Associate shall make its internal practices, books and records records, including policies and procedures and Protected Health Information, relating to the use and disclosure of Protected Health Information available to received from, or created or received by Business Associate on behalf of Covered Entity and available to the Secretary of the U.S. Department of Health and Human Services (the “Secretary”) Covered Entity for purposes of determining Business Associate s Covered Entity’s compliance with the Privacy Rule. Business Associate shall provide to Covered Entity a copy of any Protected Information that Business Associate provides to the Secretary concurrently with providing such Protected Information to the SecretaryRule as applicable.

Business Associate shall provide to Covered Entity a copy of any Protected Information protected health information that Business Associate provides to the Secretary concurrently with providing such Protected Information protected health information to the Secretary.
