Good Faith and Fair Dealing. The Parties agree to act in accordance with the principles of good faith and fair dealing in the performance of the Agreement.
Good Faith and Fair Dealing. Each Party hereby agrees that its performance of all obligations and exercise of all rights under this Agreement shall be governed by the fundamental principles of good faith and fair dealing.

Good Faith and Fair Dealing. Sears and SHO each shall exercise Good Faith in the performance of its obligations in this Agreement. “Good Faith” means honesty in fact and the observance of reasonable commercial standards of fair dealing in accordance with applicable law.
