Common use of Global Data Link Service Clause in Contracts

Global Data Link Service. In lieu of any other rates and discounts, Customer will pay a fixed monthly recurring per-circuit local loop charge of $20,136 and a non-recurring charge of $12,000 for OC-48c (STM-16) Global Data Link Service (originating in the United States terminating in Japan) at 1 Circuit ID mutually agreed upon by Customer and Company. This circuit has a term of two (2) years, commencing when the circuit is installed. If either (i) Customer terminates for its convenience, or (ii) Company terminates for Customer’s uncured breach, the circuit prior to the expiration of the minimum payment period, Company will invoice and Customer will pay and early termination charge equal to the product of fifty percent (50%) of the monthly recurring charge for the circuit multiplied by the number of months remaining, if any, in the minimum payment period of the date of termination. Customer will not be liable for the payment of early termination charges if Customer terminates the Global Data Link Service for Cause as defined in the Agreement.
