General Design Requirements. 16.1 The Design-Builder is responsible for the means, methods, techniques, sequences and procedures necessary to properly complete the Design in conformance with this Agreement, including the Project Management Plan and the Time Schedule.

General Design Requirements. All plant and equipment shall be suitable for operation under the design ambient conditions as detailed in Section 2.0. The Contract Works shall be designed to facilitate inspection, cleaning and repairs, and for the operation in which continuity of service is the first consideration. All apparatus shall be designed to ensure satisfactory operation under such sudden variations of load and voltage as may be met with under working conditions on the system and short-circuits, within the rating of the apparatus. The design shall incorporate every reasonable precaution and provision of the safety of all those concerned in the operation and maintenance of the Contract Xxxxx.Xxxxxxxxx shall be designed for reliable operation and ease of maintenance. All material used shall be new and of the best quality and of the class most suitable for working under the conditions specified and shall withstand the variations of temperature and atmospheric conditions arising under working conditions without distortion or deterioration or the setting up of undue stresses in any part. No welding, filling or plugging of defective parts will be permitted without the sanction in writing of the Engineer. All components shall be new and shall be manufactured from sound materials, completely free from all visible imperfections such as cracks, flaws, blow holes, etc. No castings, forgings or other material will be accepted in a condition known to be faulty. Corresponding parts liable to renewal shall be interchangeable. When required by the Engineer, the Contractor shall demonstrate this quality. All apparatus shall operate without undue vibration and with the least practicable amount of noise. Cast iron shall not be used for xxxxxxxx of fluid-filled apparatus or for any part of the equipment which is in tension or subject to impact stresses except where it can be shown that service experience has been satisfactory with the grade of cast iron and the duty proposed. Operating boxes, kiosks, cubicles and similar enclosed compartments forming part of auxiliary equipment shall be adequately ventilated to restrict condensation. All Contactor or relay coils and other parts shall be suitably protected against corrosion. Anti-condensation heaters of an approved type shall be provided inside each cubicle or where necessary each cubicle compartment. General Design Requirements. Plan development phases shall be completed no later than the proposed project schedule outlined at the end of this exhibit, exclusive of delays beyond the consultant’s control. The consultant shall submit to the City (and to the KDOT Secretary of Transportation upon request) progress reports at monthly or at mutually agreed intervals in conformity with the project schedule. The consultant shall design the Project in conformity with the state and federal design criteria appropriate for the Project in accordance with the current Project Development Manual for Non- National Highway System Local Government Road and Street Projects, Volumes I and II, Bureau of Local Project’s (BLP) project memorandums, memos, the KDOT Design Manual, Geotechnical Bridge Foundation Investigation Guidelines, Bureau of Design’s road memorandums, the City’s approved Project Development Procedures for Non-NHS Projects/Project Procedures Manual/KDOT Project Procedures Manual-City of Overland Park, Kansas, the current version of the Manual on Uniform Traffic Control Devices (MUTCD) as adopted by the Secretary, and the current version of the KDOT Standard Specifications for State Road and Bridge Construction with Special Provisions, and with any necessary Project Special Provisions with the rules and regulations of the Federal Highway Administration pertaining thereto. The Design plans shall be signed and sealed by the licensed professional engineer responsible for the preparation of the design plans. Geological investigations or studies shall be signed and sealed by the licensed Geologist responsible for the preparation of the geological investigations or studies. Rights of way descriptions shall be signed and sealed by the licensed land surveyor responsible for the preparation of the rights of way descriptions.

INDOT’s standards, practices, policies, guidelines and specifications shall control in case of a conflict, except for erosion control measures in which the IDEM Indiana Stormwater Quality Manual shall control in case of conflict. Only design firms that are prequalified with INDOT for the work types specified, and that are sufficiently staffed and capable of performing the required work, shall be used on the Design-Build Contractor team on the project. The required capabilities include successful completion of designs for major road and bridge projects. The Design-Build Contractor’s design firms will be considered as subcontractors responsible for the design and engineering of the project. Multiple design firms may work on the Design-Build Contractor team, however, one design firm shall be designated as the prime design firm. The Design- Build Contractor shall assign professional engineers and surveyors licensed in the State of Indiana to be in direct responsible charge of all engineering and surveying work. If services are required that are predominantly oriented toward other disciplines, such as environmental, landscaping, transportation planning, or architectural applications, the Design-Build Contractor shall assign other professionally competent personnel registered or licensed in the State of Indiana to be in charge of the work. Plans signed and stamped by a professional engineer shall be developed in accordance with INDOT's plan preparation guidelines. Specifications and details shall be provided. In addition, electronic files on disk in Portable Document Format (PDF) and AutoCAD (.dwg) or MicroStation (.dgn) format shall be provided.

General Design Requirements. All plan development stages shall be completed no later than the current project schedule’s due dates as issued by KDOT, exclusive of delays beyond the consultant’s control. If requested, the consultant shall submit to the City (and to the KDOT Secretary of Transportation) progress reports at monthly or at mutually agreed intervals in conformity with the official project schedule. Because of the Secretary of Transportation of the State of Kansas’ (Secretary’s) obligation to administer state funds, federal funds, or both, the Secretary shall be a third party beneficiary to this agreement between the City and Consultant. This third party beneficiary status is for the limited purpose of seeking payment or reimbursement for damages and costs the Secretary or the City or both incurred or will incur because the Consultant failed to comply with its contract obligations under this Agreement or because of the Consultant’s negligent acts, errors, or omissions. Nothing in this provision precludes the City from seeking recovery or settling any dispute with the Consultant as long as such settlement does not restrict the Secretary’s right to payment or reimbursement.
