General Contractual Provisions. 35 The Collective Bargaining Agreement for the school year 2008-2011 is the sole Collective Bargaining 36 Agreement between the BOARD and the ASSOCIATION. 37 It is the intention of the parties hereto that this Collective Bargaining Agreement shall control the rights, 38 duties, responsibilities and relationships of the parties during the contractual period rather than some prior policy or 39 procedure which may have been utilized prior to the effective date of this Collective Bargaining Agreement.
General Contractual Provisions. This Agreement is the complete and exclusive statement between the parties regarding the subject matter of this Agreement. All notices must be in writing. Any modification to the terms and conditions of this Agreement must be in writing and by all parties. If any dispute arises, the prevailing party shall be entitled to receive reasonable attorney’s fees and costs, in addition to any other relief it may be awarded. The Section heading used in this Agreement are for convenience reference only and will not limit or extend the meaning of any provision of this Agreement. If any provision of this Agreement is held to be invalid or unenforceable for any reason, the remaining provisions will continue in full force. The waiver by either party or breaching of any provision of this Agreement will not operate or be interpreted as a waiver of any other or subsequent breach. This Agreement or any interests therein shall not be assigned by either party without the prior express written consent of the other party. This Agreement shall be binding on and inure to the benefit of the successors and assigns of the parties hereto.

Entire Agreement This is the entire agreement between the Parties with respect to the matters referred to in this Agreement, and there are no representations, warranties, covenants, agreements, conditions, terms, collateral agreements by either of the Parties to the other, or between the Parties, in respect of its subject matter other than those expressed in this Agreement. Despite the Protocol and Municipal Services Coordination Guide being attached to this Agreement as Schedules, their provisions are not incorporated into and do not form part of this Agreement, and they do not have any function or weight in the context of any interpretation of this Agreement (except to the limited extent of documenting who to contact or provide a notice to under this Agreement).
General Contractual Provisions. 1.18.1. Oral collateral agreements have not been made by the contracting parties. Subsequent additions or amendments to the concluded agreements must be made in writing. An oral waiver of the written form is excluded.
