General Agreement Relating to Proceedings. The Executive has not filed, and except as provided in Sections 3(b) and 3(c), the Executive agrees not to initiate or cause to be initiated on his behalf, any complaint, charge, claim or proceeding against the Releasees before any local, state or federal agency, court or other body relating to his employment or the termination of his employment, other than with respect to the obligations of the Company to the Executive under the Employment Agreement (each, individually, a “Proceeding”), and agrees not to participate voluntarily in any Proceeding. The Executive waives any right he may have to benefit in any manner from any relief (whether monetary or otherwise) arising out of any Proceeding.
General Agreement Relating to Proceedings. The Executive has not filed, and except as provided in Paragraphs 4(b) and 4(c), the Executive agrees not to initiate or cause to be initiated on his behalf, any complaint, charge, claim or proceeding that is released hereunder against any party released herein before any local, state or federal agency, court or other body, other than with respect to the obligations of the Corporation or any other party released herein to the Executive under this Agreement or any indemnification or other rights the Executive may have as listed in Paragraph 3(a) (each, individually, a “Proceeding”), and agrees not to participate voluntarily in any Proceeding. The Executive waives any right he may have to benefit in any manner from any relief (whether monetary or otherwise) arising out of any Proceeding.

The parties represent and warrant that they have not filed, and they agree not to initiate or cause to be initiated on their behalf, any complaint, charge, or claim against the other party before any local, state or federal agency, court or other body relating to the Executive’s employment or the termination thereof, other than with respect to any claim that is not released hereunder including with respect to the obligations of the Company to the Executive and the Executive to the Company under the Employment Agreement (each, individually, a “Proceeding”), and each party agrees not to participate voluntarily in any Proceeding. The parties waive any right they may have to benefit in any manner from any relief (whether monetary or otherwise) arising out of any Proceeding.

The Executive waives any right he may have to benefit in any manner from any relief (whether monetary or otherwise) arising out of any Proceeding.

Neither party has filed and, except as provided in Sections 11(d)(ii) and 11(d)(iii), the parties hereby agree not to initiate or cause to be initiated on their behalf, any complaint, charge, claim or proceeding against the other that is released by Section 11 of this Agreement. The parties respectively waive any right they may have to benefit in any manner from any relief (whether monetary or otherwise) arising out of any proceeding for a claim released herein.

Xxxxxx has not filed, and except as provided in Section 17(b)(ii) hereof, Xxxxxx agrees not to initiate or cause to be initiated on his behalf, any complaint, charge, claim or proceeding against the Released Parties before any local, state or federal agency, court or other body relating to matters released pursuant to Section 17 (each, individually, a “Proceeding”), and agrees not to participate voluntarily in any Proceeding. Xxxxxx waives any right he may have to benefit in any manner from any relief (whether monetary or otherwise) arising out of any Proceeding.

You have not filed and, except as provided in Sections 12(d)(ii) and 12(d)(iii), you hereby agree not to initiate or cause to be initiated on your behalf, any complaint, charge, claim or proceeding against the Releasees that is governed by this Release before any local, state or federal agency, court or other body relating to your employment or your departure therefrom, other than with respect to the obligations of the Company to you under the Employment Agreement (each, individually, a “Proceeding”), and agree not to participate voluntarily in any Proceeding. You hereby waive any right you may have to benefit in any manner from any relief (whether monetary or otherwise) arising out of any Proceeding.
General Agreement Relating to Proceedings. Xxxxxxxxx hereby represents that as of the Execution Date he has not filed, and except as provided in Section 16(b)(ii) hereof, Xxxxxxxxx agrees not to initiate or cause to be initiated on his behalf, any complaint, charge, claim or proceeding against the Released Parties before any local, state or federal agency, court or other body relating to matters released pursuant to Section 16.
