Further Competition Award Criteria. Where a Contracting Body may require Suppliers to develop proposals or a solution in respect of its Statement of Requirements or need to amend or refine the terms of the Call-Off Contract to reflect its Statement of Requirements to the extent permitted by and in accordance with applicable laws (including procurement laws and all necessary guidance), the following criteria shall be applied to the Services set out in the Framework Service Providers' compliant tenders submitted through the Further Competition Procedure: Determine its requirements in accordance with paragraph 3.1 of Framework Agreement Schedule 5 (Ordering Procedures); Due to the range and complexity of the NHS and Wider Public Sector Contracting Body’ Statement of Requirements, the Authority reserves the right for Contracting Bodies to define the sub-criteria, including weightings, as part of the Further Competition Award process; and The only exception to paragraph 1.2 above is where it is not possible for the Contacting Body to determine the sub-criteria weightings. In this case, the Contracting Body is obliged to provide the Framework Agreement headline award criteria, and weightings in the tender documentation. The weightings to be applied to the sub-criteria may be disclosed at a later stage but before bids are opened provided that the decision to do so:- does not alter the Further Competition Award criteria set out in the contract documents; does not contain elements that, if they had been known at the time the bids were prepared, could have affected that preparation; and is not adopted on the basis of matters likely to give rise to discrimination against bidders.
