For Settlement Purposes. If the Effectiveness Time does not occur, the Parties agree that Delaware Uniform Rule of Evidence 408 will apply to this Agreement and none of this Agreement or any negotiations of the terms of this Agreement will be admissible for any purpose in the Litigation.
