Following December. From January onward, only those regular full- time or part-time employees who had a maximum sick leave accrual level for payout purposes established or "frozen" for them on December i n accordance with Articles and above, shall be eligible to receive sick 'leave payout, and then, only pursuant to Articles through below. A regular full- time or regular part-time employee who is eligible for a sick leave payout i n accordance with Article and who retires on or after January shall be eligible to receive a salary grant of seventy-five percent (75%) of the sick leave accrual such employee actually has to his credit on the date of retirement; PROVIDED always that such employee shall not receive an amount which is greater than seventy-five percent (75%) of the maximum sick leave accrual level for payout purposes established for such employee on December under Article and above. After ten years' continuous service, a regular full- time or regular part-time employee who is eligible for a sick leave payout i n accordance with Article and whose employment terminates on or after January shall be eligible to receive a salary grant of percent (75%) of the sick leave accrual such employee actually has to his credit on the date of termination, PROVIDED always that such employee shall not receive an amount which is greater than seventy-five percent (75%) of the "frozen" sick leave accrual level for payout purposes established for such employee on December under Articles and above. This Article shall not apply i n cases where an employee i s discharged for cause, or i n cases of retirement which are covered under Article Employees receiving severance pay under this Article shall not also receive severance pay under Article of the Collective Agreement. In addition to the foregoing, it is clearly understood that fifteen (15) employees each calendar year shall be entitled to claim a payout of their “frozen” sick leave accrual at the seventy-five percent (75%) level as established above. The first ten (10) employees per year shall be selected in order of greatest seniority, The next five (5) employees shall be selected in order of least seniority. Should an employee who has been offered this payout opportunity decline, then such employee will have another opportunity after all other employees have had their opportunity to receive their payout.
Following December. 31, 1999, Prima shall have the right to terminate this Agreement in the event Strippit shall have failed, as of such date, to sell [*] units of the Products. Prima shall provide Strippit written notice of its intention to terminate this Agreement under this paragraph 3.4 and the effective date thereof within 30 days following December 31, 1999. In the event Prima does not exercise such right of termination within said 30-day period, such right shall be deemed waived and this Agreement shall remain in full force and effect.

  • Effective January A member who is medically unfit for duty at the time of the commencement of his scheduled vacation as a result of an injury or illness compensable under the Workplace Safety and Insurance Act and in receipt of benefits from the Workplace Safety and Insurance Board or 2) for which medical documentation has been provided and which has resulted in an approved medical leave or being unfit for regular duties each for days or more, shall be entitled to reschedule his vacation, provided the vacation as rescheduled is taken before December of the calendar year in which the injury occurred, or December of that year if approved by the Chief of Police, such approval not to be unreasonably withheld. If the member remains medically unfit for duty such that the rescheduled time is not taken by December as aforesaid, the member shall be entitled to choose to either (1) receive in the first pay period of the following calendar year an amount equal to the salary he would normally receive in respect of the vacation time not taken or (2) carry over the vacation to the following year, to be scheduled as approved by the Chief or his designate. In the event that the member chooses to carry over the vacation to the following year, the time must be taken prior to the end of the following calendar year. In the event that the carried-over time is not taken prior to the end of the following calendar year, the member shall receive a payout at the salary rate applicable when the vacation time was earned. It is further understood and agreed that regardless of seniority, no scheduling of any carried over vacation time will result in any member's scheduled vacation being cancelled or bumped. A member who is on suspension, either paid or unpaid, at the time of the of his scheduled vacation, shall not be required to report in for the period of his scheduled vacation. A member who is on suspension, either paid or unpaid, and who has not scheduled his vacation for the year shall do so as soon as requested and, once such vacation time is approved, shall not be required to report in during the scheduled vacation time.
