FOB Destination. Shipping charges are included in the price of the item and the shipped item becomes the legal property and responsibility of the receiver when it reaches its destination unless there is acceptance testing required. FOB Inside Delivery. Special Shipping arrangements, such as inside delivery, may include additional fees payable by the OETC Member. Any FOB inside delivery must be annotated on the OETC Member’s Purchase Order.
FOB Destination. Respondent's prices shall include delivery of all items F.O.B. destination or as otherwise specified by the State.
FOB Destination a. Unless otherwise specified, the Contractor shall furnish all supplies to be delivered under this Contract ""F.O.B. Destination."" As used herein, "F.O.B. Destination" means:
i. Free of expense to WMATA on board the carrier's conveyance, at a specified delivery point where WMATA's facility (plant, warehouse, store, lot, or other location to which shipment can be made) is located; and
ii. Supplies shall be delivered to WMATA's warehouse unloading platform, or receiving dock, at the Contractor's expense. WMATA shall not be liable for any delivery, storage, demurrage, accessorial, or other charges involved before the actual delivery of the supplies to the destination, unless such charges are caused by WMATA's acts or omissions, acting in its Contractual capacity. If the Contractor uses a rail carrier or freight forwarder for less than full carload shipments, the Contractor shall assure that the carrier will furnish tailgate delivery, if transfer to truck is required to complete delivery to WMATA.
b. The Contractor shall:
i. Pack and mark the shipment to comply with this Contract's specifications;
ii. In the absence of specifications, prepare the shipment in conformance with the carrier’s requirements;
iii. Prepare and distribute commercial bills of lading;
iv. Deliver the shipment in good order and condition to the delivery point specified in this Contract;
v. Be responsible for any loss of and/or damage to the goods occurring before WMATA’s receipt of the shipment at the delivery point specified in this Contract;
vi. Furnish a delivery schedule and designate the mode of delivering carrier; and
vii. Pay and bear all charges to the specified point of delivery.
FOB Destination. Destination: Means goods are to be delivered to the destination identified in the Purchase Order by the user, which is the point at which the user accepts ownership or title to goods. Laws of New Mexico specifically prohibit acceptance of ownership of goods in transit. ANY exception to FOB Destination may cause a bid to be declared non-responsive.
FOB Destination. Do not check this block unless you anticipate assuming liability for shipped supplies at the origin point (this is not recommended if avoidable) Block 12. Discount terms. Leave blank.
FOB Destination. Title changes hand from Vendor to purchaser at the destination point of the shipment; Vendor owns commodity in transit and files any claims, and Vendor pays all freight and any related transportation charges. A solicitation may request Vendors to separately identify freight charges in its bid, but no amount or charge not included as part of the total bid price will be paid.

NetIQ and Tech Data agree that no title or ownership of the proprietary rights to any software code is transferred by virtue of this Agreement notwithstanding the use of terms such as "purchase", "sale" or the like within this Agreement. NetIQ retains all ownership rights and title to any software code within the Products.
