Common use of Fixed Term Employee Clause in Contracts

Fixed Term Employee. Fixed-term employee - shall mean an employee who is engaged as such to work for a specific task or period of time. A fixed-term employee shall for all intents and purposes receive the same benefits under this agreement as would a full-time employee, provided that accruals of any benefits and rights are calculated on a pro-rata basis. Fixed-term employees may be required to work up to a maximum of 144 ordinary hours over a 28 day cycle. By mutual agreement these hours may be increased or varied to suit the needs of the employer and the employee. Where it is necessary to terminate the employment of a fixed-term employee’s employment for misconduct, poor performance or incapacity to perform work or for any other reason prior to their agreed tenure being completed, the fixed-term employee shall receive the same notice as a full-time employee under this agreement. Provided that where the fixed-term employee has their employment terminated for wilful or serious misconduct they shall only receive payment up until the time of termination. It is a condition of employment for a fixed-term employee that the employer shall not be required to pay out the remainder of their tenure where the fixed-term employee is terminated for misconduct, poor performance or incapacity to perform work or for any other reason prior to their agreed tenure being completed.
