Fixed Limit of Construction Cost. The Fixed Limit of Construction Cost, referred to hereinafter as the FLCC, is the total dollar value of the sum of the project's anticipated base bid.

Fixed Limit of Construction Cost. 4.3.1 Before the Professional begins the Project, the Owner shall provide the Professional with a budget of all funds available for the total Project. The total Project includes the Contract(s) for construction, including information technology, furnishing, and equipping, if applicable, all fees, special Consultants and Contracts, advertising costs, code compliance expenses, a reasonable contingency, and any other expenses necessary to complete the Project and deliver a useful facility to the Using Agency. Where project services as defined in Paragraph 2.1.1 do not include any phase beyond Construction Document Phase, the total Project and budget shall include only the fees based on a percentage of estimated construction cost, special Consultants and Contract, and any other expenses needed to complete the planning of the Project through completion of the last designated planning phase. The Professional agrees that unless the Project, as designed by him covering the complete Scope of the Work, can be actually completed within the budget of funds available, the Owner shall not be obligated to the Professional for any part of the Professional's fee beyond the last Owner-approved phase.
Fixed Limit of Construction Cost. In performing its design services, the Design Professional will use its best efforts to design the Project in a manner that has Construction Cost fall within the Fixed Limit of Construction Cost. In doing so, the Design Professional will be permitted to determine, in accordance with the Design Guidelines and the Owner’s program, as defined in the Schedule of Project Details, what materials, non-medical equipment, non-medical component systems and types, and means of construction are to be included in the Contract Documents and, with the Owner’s prior approval, to make reasonable adjustments in the scope of the Project. The Design Professional will, as part of its Basic Services hereunder, include “alternates” to provide a mechanism to adjust Construction Cost so that they remain within the Fixed Limit of Construction Cost; provided, however, that such alternates will not compromise the Owner’s program for the Project.
Fixed Limit of Construction Cost. The term “Fixed Limit of Construction Cost” shall set forth a dollar amount available for the total Construction Cost of all elements of the Work as specified by the Principal Representative.

Fixed Limit of Construction Cost. Upon the completion of Schematic Design, the Contractor shall furnish a detailed estimate of construction costs for the Project. From this estimate, the Owner and Contractor shall negotiate a Fixed Limit of Construction Cost (“FLCC”). This FLCC shall include an escalation factor and contingencies as agreed upon by all parties. The Contractor shall be responsible for maintaining construction costs within the FLCC. No changes or revisions to the FLCC shall be made without the Owner’s prior approval. During the Pre-Construction Phase, it is the responsibility of Contractor to adjust the FLCC, if deemed necessary; such an adjustment, if accepted by the Owner, will be effectuated through an amendment to this MOU.

To enable the Design Professional to design within such Fixed Limit of Construction Cost, the Design Professional shall be permitted to determine, in accordance with the Owner’s design guidelines and program, as defined in the Schedule of Project Details, what materials, non-medical equipment, non-medical component systems and types, and means of construction are to be included in the Contract Documents, and to make reasonable adjustments in the scope of the Project to assure that the Construction Costs are not exceeded. The Design Professional shall, as part of its Basic Services hereunder, include alternate bids in the Contract Documents to provide a mechanism to adjust the Bid Pricing to remain within the Fixed Limit of Construction Cost; provided, however, such alternates shall not compromise the program for the Project without the written acceptance of the Owner.
Fixed Limit of Construction Cost as defined in the Design Professional’s Agreement, is identified in the Schedule of Project Details. The Fixed Limit of Construction Cost includes the Construction Manager’s Contingency. Neither the estimated nor the final Construction Cost may exceed the Fixed Limit of Construction Cost without prior written approval of the Owner. The Construction Manager shall collaborate with the Design Professional during the design and bidding of the Project to achieve the objective of complete construction of the Project for a Construction Cost that does not exceed the Fixed Limit of Construction Cost. If, during the collaboration process, there is any indication the Construction Cost may exceed the Fixed Limit of Construction Cost, the Construction Manager shall consult and cooperate with the Design Professional in making recommendations to the Owner for corrective action toward meeting the Owner’s requirement of having the Construction Cost be no greater than the Fixed Limit of Construction Cost.
