Neither the Company nor any of the Subsidiaries has incurred any liability for any finder’s fees, brokerage commissions or similar payments in connection with the transactions herein contemplated, contemplated except (i) with respect to Agent pursuant to this Agreement or (ii) as may otherwise exist with respect to Agent pursuant to this AgreementCredit Suisse Securities (USA) LLC.

Finder’s Fees. Neither the Company nor any of the Subsidiaries Subsidiary has incurred any liability for any finder’s fees, brokerage commissions or similar payments in connection with the transactions herein contemplated, except as may otherwise exist with respect to Agent Xxxxxxxxxx pursuant to this Agreement.
