Fences and Gates. After reaching an agreement with the landowner, Hydro-Québec shall install gates or temporary fences inside the right-of-way where needed to protect crops, livestock and property outside the right-of-way . Fences inside the right-of-way that run along public access roads shall have rigid gates to prohibit access to the right-of-way, except during maintenance . In case of existing electric fences, Hydro-Québec may do one of the following: • Install an arch . • Modify the power supply to supply the fence from both sides of the gate . Gates shall be installed as follows: • Shore up posts on either side of the opening to maintain mechanical tension in adjacent spans . • Manually cut wire and, if adequate, use it to build the gate; if not, recover the cut wire and use material of equivalent or higher quality to build the gate . Hydro-Québec shall ensure that the contractor responsible for maintenance maintains the gates in good condition and keeps them closed at all times, as instructed by the Hydro-Québec representative . In addition, any fence or temporary gate shall be visible at all times to anyone with access to the right-of-way . Any fence or gate that is cut, removed, damaged or destroyed shall be immediately repaired or replaced with material of equivalent or higher quality . When the maintenance work is completed, temporary gates shall be removed, barring agreement otherwise with the landowner . If stone or pole fences must be taken down, the material removed shall be stored and used to rebuild the fence when the maintenance work is completed .‌‌‌‌ Hydro-Québec shall maintain appropriate protection systems for livestock . Any fence needed to keep out particular kinds of animals shall be described in specific mitigation measures, e .g ., fences running along the right-of-way or allowing animals to cross it .

Fences and Gates. If any part of the Leased Premises, or the improvements thereon, are enclosed within the secure area of the Airport, Lessee shall provide all materials and labor, at its sole cost, necessary to comply with the Airport Security Plan and TSA Section 49 CFR Part 1542 (Airport Security). Lessee shall pay the cost of all additional gates or doors required for access by Lessee and its employees, business invitees, or others from the landside of the Airport to the air side of the Airport into the secure area. Lessee shall install an entry card system approved by the SRA pursuant to the Airport Security Plan submitted to and approved by the FAA at all security gates or doors on the Leased Premises. Any alteration of the communication devices or entry card system, which may be necessitated by a change in Governmental Requirements shall be paid for by Lessee.

Employee parking must be separated from customer parking by a 6’ tall fence or by the building. Fabric shall be chain link, No. 9 gauge wire woven in a 2 inch mesh. Fabric may be aluminum coated (ASTM A491) or zinc coated (ASTM A392). Posts, gates and other appurtenances shall be hot dipped, galvanized Schedule 40 pipe. Gates shall be complete with corner fittings and ball and socket hinges. Provide standard catches, stops and key operated cylinder style locks. Special double swing or double cantilevered slide gates may be required on some projects. Materials and installation standards shall conform to the “Standard Guide” as published by the Chain Link Fence Manufacturers Institute (CLFM1). Storm and Drainage Fencing: Fencing and access gates are required for all detention, retention, or drainage ditches which pass through or are located on the site. The owner shall install a 4-foot high fence system completely around the perimeter of these areas. The fence shall have a bottom rail located no more than 2 inches above finished grade, and a top rail along the fence perimeter. The horizontal fence members shall be located on the hazardous side of the fence. Maximum mesh size for this fence shall be 1 1/2” square, 9 gauge chain link unless the fence is provided with slats fastened at the top and bottom which reduce the openings to not more than 1 3/4”. There shall be at least 1 6-foot wide access gate provided for maintenance and shall be lockable by use of a key.

Fences and Gates. Xxxxxx agrees that Lessee will not cut or go over any fence or fences on the Leased Premises at any time or in connection with any operations on the Leased Premises, without first obtaining Surface Owner’s express consent thereto in writing. If Surface Owner consents to the cutting of a fence, the cuts must be made at the place designated by Surface Owner; and Xxxxxx agrees, prior to cutting any fence of Surface Owner, to brace the existing fence adequately on both sides of the proposed cut so that when the fence is cut there will be no slackening of the wires. If the fence cut is an outside fence of Surface Owner’s property, Xxxxxx agrees, if requested by Surface Owner, to install and maintain a substantial iron cattle guard capable of turning cattle promptly after making such cut. A welded pipe gate shall be installed across said cattle guard, and when not in actual use, the gate shall be kept locked by Xxxxxx. If Surface Owner does not request a cattle guard, then Lessee shall install a substantial metal gate, which shall be kept locked by Lessee when not in actual use. Surface Owner may install Surface Owner’s own lock in addition to Xxxxxx’s lock on said gate. If the fence to be cut is an internal fence of Surface Owner’s property, Xxxxxx agrees to install a substantial metal gate or cattle guard, whichever shall be designated by Surface Owner, in such opening. Upon termination of this Lease, or the portion thereof on which any cattle guard and gate are located, such cattle guard and gate shall, at the option of Surface Owner, become Surface Owner’s property or be removed by Xxxxxx and the fences restored to their original condition. So long as this Lease shall remain in force, such gates and cattle guards shall not be removed and shall be maintained in good condition and repair, capable of turning cattle. Any gates in fences must be installed only at places and in a manner reasonably approved by the Surface Owner. Xxxxxx agrees to promptly close all gates and lock all outside gates which Xxxxxx and Xxxxxx’s agents, servants, employees, guests, invitees or independent contractors may use in Lessee’s operations on the Leased Premises, to prevent the escape of cattle or stock through any open gate.
Fences and Gates. Operator shall not cut, destroy or remove any existing fences without the express written approval of Owner, which approval shall not be unreasonably withheld. If Operator damages any existing fences during its operations, Operator shall promptly repair said fence in a proper and workmanlike manner. Operator shall keep all existing gates closed at all times. If Operator installs additional gates in any fence constructed by Operator and Operator desires to lock such gates, Operator shall provide a key to such gates upon Owner’s request. Where and as necessary to protect livestock operations, Operator shall construct cattle guards at all fence crossings which are used by Operator. Installation of new cattle guards, fence braces, wings, and metal gates shall be at the sole cost of Operator. Fences and Gates. Construction, installation, maintenance, repair and replacement of appropriate controls, including fences, gates, walls, boulders and the like, for the purposes of (a) preventing access to and use of the Premises except as permitted by the Limited Non-Exclusive Access License granted hereunder , (b) preventing access between the Premises and the Grantor’s Remaining Land, and/or (c) preventing or mitigating any unsafe condition associated with the Premises in relation to its surroundings such as preventing access to or across a nearby active railroad line, steep slopes, and other pre-existing, abutting conditions.
