Failure to Meet Timelines. Failure by the Union to comply with the timelines will result in the automatic withdrawal of the grievance. Failure by the Employer to comply with the timelines will entitle the Union to move the grievance to the next step of the procedure.
Failure to Meet Timelines. The time limits in this Article must be strictly adhered to unless mutually modified in writing. Failure by the Union to comply with the timelines will result in the automatic withdrawal of the grievance. Failure to Meet Timelines. Failure by the Union to comply with the initial thirty (30) day deadline contained in Subsection 23.3(a), below, will result in the automatic withdrawal of the grievance. Failure by the Union to comply with other timelines contained in this Grievance Procedure may be submitted to the arbitrator for his or her determination. Failure by the Employer to comply with the timelines will entitle the Union to move the grievance to the next step of the procedure.

Failure to Meet Timelines. The grievance shall be considered resolved if one of the parties has not responded before the time period for appealing has passed. Failure at any step of this procedure to communicate the decision on a grievance within the specified time limits (unless extended by written mutual agreement) shall permit the aggrieved to proceed to the next level.

A grievance shall be considered dropped if the grievant fails to request initial or further consideration of the grievance at each level within the time limits specified in these procedures. If the District fails to respond to a grievance within the specified timelines, the grievance shall be considered denied at that level and may be appealed.
Failure to Meet Timelines. Failure at any step of this procedure to communicate the decision on a grievance by the District within the specified time limits shall permit proceeding to the next step of the procedure within the time allotted had the decision been given. If the grievance is not processed by the grievant or grievants in accordance with the time limits, the decision last made by the District shall be deemed final.
Failure to Meet Timelines. (a) In the event the initiator of the grievance fails to follow the procedure and time limits established in the steps of the Grievance Procedure, the grievance shall be deemed to be abandoned.
Failure to Meet Timelines. County’s failure to meet any of the timelines set forth in this Article shall not be deemed to be a breach of this Agreement by County absent a showing of willful misconduct, and shall not relieve Landowner of any obligations under this Agreement, provided that County is not otherwise in breach of this Agreement. County shall, upon request by Landowner and at the sole expense of Landowner, engage outside consultants, to the extent same is permitted by County policy and the County Charter, to assist in the efforts to complete such processing within the timelines described herein.
