Failure to Meet Time Limits. If a grievance is not processed by the grievant in accordance with the time limits set forth in this Article, it shall be considered settled on the basis of the decision last made by the District. If the District fails to respond to the grievance in a timely manner at any level, the running of the time limit shall be deemed a denial of the grievance and termination of the level involved, and the grievant may proceed to the next step.

The above grievance procedure affords the sole and exclusive remedy for complaints and grievances under the Agreement and the sole method of expression or communications of a view, grievance, complaint, or opinion on any matter related to this Agreement.

Failure to Meet Time Limits. 19 A bargaining unit member who fails to comply with the time limit specified in 20 Section 3.3 will forfeit all right to the application of the grievance procedure for 21 the alleged contract violation.

The failure of a Certified Staff member or the Association to act on any grievance within the prescribed time limits will act as a bar to any further appeal and an administrator’s failure to give a decision within the time limits shall permit the grievant to proceed to the next step. The time limits, however, may be extended by mutual agreement.

If the finding or resolution of a grievance at any step of the procedure is not continued within the prescribed time limits, said grievance shall be considered resolved on the basis of the last answer provided and there shall be no further appeal or review.
