Common use of Failure to Cooperate Clause in Contracts

Failure to Cooperate. If an Insured fails to cooperate with SHL’s administration of this section, the Insured may be responsible for the expenses for the services rendered and if legal action is taken, a court could make the Insured responsible for any legal expense incurred by SHL to enforce its rights under this section. Insured cooperation includes the completion of the necessary paperwork that would enable SHL to collect payment from the Primary Plan for services. Any benefits paid to the Insured in excess of actual expenses must be refunded to SHL.
