Common use of Failure to Appoint Clause in Contracts

Failure to Appoint. If the party receiving the notice fails to appoint an arbitrator, or if the two appointees fail to agree upon a chairperson within seven (7) days of their appointment, the appointment shall be made by the Minister of Labour upon request of either party.

If if the party receiving recipient of the notice fails to appoint an arbitratora nominee, or if the two appointees nominees fail to agree upon a chairperson single Arbitrator, or if the parties are unable to agree upon a single arbitrator within seven fifteen (7) days 15)days of their appointmentthe date that notice to arbitrate was received, the any necessary appointment shall be made by the Minister of Labour Labour, upon the request of either party.

Failure to Appoint. If the party receiving the notice fails to appoint an arbitrator, or if the two appointees fail to agree upon a chairperson within seven fourteen (714) calendar days of their appointment, the appointment shall be made by the Minister of Labour upon request of either party.
