Failure to Appeal. Failure to file a Step 2 grievance within the above time limit shall be construed as an Agreement to the disciplinary action by the affected employee and the Union. All subsequent appeal rights shall be deemed waived.
Failure to Appeal. The failure of the grievant to appeal any decision to the next step within the time set forth for such appeal shall constitute a waiver of the right of further appeal in all cases (except one in which the Municipal Civil Service Commission exercises jurisdiction), and a final disposition of the grievance shall be made on the basis of the last decision given so far as the Board of Education grievance steps are applied.
Failure to Appeal. Failure of the grievant to appeal a decision at any step within the specified time shall constitute a withdrawal of the grievance. Any step or time limitation of the grievance procedure may be waived by written mutual agreement of the District and the grievant.
Failure to Appeal. If the employee against whom a recommendation for discipline has been filed fails to file a notice of appeal within the time specified in these rules, the employee shall be deemed to have waived his/her right to appeal. If the recommendation has not already been ordered into effect on an interim basis according to Section 9 of this Article, the person making the recommendation may order the recommended disciplinary action into effect, and such action shall be reported to and made subject to ratification by the Board of Trustees. A copy of the ratified order shall be served upon the employee by registered or certified mail, return receipt requested.
Failure to Appeal. If a decision on a grievance is not appealed within the time limits specified at any level of the procedure, the grievance will be deemed settled on the basis of disposition at that level and further appeal shall be barred.
Failure to Appeal. The failure of the grievant or the Union to act within the time limits set forth shall preclude further appeal of the grievance. Upon failure of the District to meet the time limits prescribed in this Article, the grievance shall be advanced to the next highest level.
Failure to Appeal. Failure at any level of this procedure by the grievant to appeal a grievance to the next level within the specified time limits shall be deemed to be acceptance of the decision rendered at that level.
Failure to Appeal. Failure of the appropriate party to appeal a response or decision at any step within the specified time shall constitute a withdrawal of the complaint or grievance. Any step of the grievance procedure may be waived with the written consent of the College and the appropriate party.
Failure to Appeal. Failure at any step of the formal procedure to appeal, within the time limit specified below, from the decision rendered at that step shall constitute acceptance of the decision.
Failure to Appeal. If a grievant which is not the CUOP fails to appeal according to the time limits contained in the formal steps of the grievance and arbitration procedure, The Xxxxxx Union shall so notify the CUOP, and the CUOP shall have an additional 10 working days after notification to appeal the grievance to the next step.
