Expiry Dating. Except as otherwise agreed to in writing by Purchaser, all Product shipped to Purchaser, on the date of shipment by Seller, shall have a shelf-life of at least the approved dating of the Product (per the Product’s ANDA) [***].
Expiry Dating. All Product delivered by IPC pursuant to this Agreement shall have, upon delivery to the carrier in accordance herewith, the greater of either [*****] percent ([*****]%) of its maximum approved shelf life OR at least twenty (20) months of shelf life remaining in accordance with the ANDA (“Minimum Period”); except, however, where Tris has authorized in writing, in advance, the shipment of a Product that does not meet the Minimum Period.
Expiry Dating. Subject to Section 4.4(d), no Supplied Product shall be Delivered to Buyer that has less than [***]’ expiry dating remaining on the date Delivered, unless the Parties agree otherwise.
Expiry Dating. CBSI will issue the expiration date for the Drug Substance based upon its currently approved shelf life. The expiry date will be printed in the format MMMYY for each batch of Product, e.g., Mar 99. The approved abbreviations are: Confidential Treatment Requested THE REGISTRANT HAS REQUESTED CONFIDENTIAL TREATMENT FOR CERTAIN PORTIONS OF THIS AGREEMENT. THOSE PORTIONS HAVE BEEN OMITTED FROM THIS COPY OF THE AGREEMENT AT THE PLACES INDICATED BY (XXXX); AND HAVE BEEN FILED SEPARATELY WITH THE SECURITIES AND EXCHANGE COMMISSION JAN = January; FEB = February; MAR = March; APR = April; MAY = May; JUN = June; JUL = July; AUG = August; SEP = September; OCT = October; NOV = November; DEC = December.
Expiry Dating. Patheon shall not assign expiration dates. Expiration dates are calculated by the Client exclusively.
Expiry Dating. Dynavax represents that [ * ] for Hepatitis B Surface Antigen. Dynavax shall use its best efforts to extend such dating, such that, subject to Section 3.5, all Hepatitis B Surface Antigen; Licensed Vaccine or Product, as the case may be, supplied by Dynavax under this Agreement will have no less than [ * ] remaining when Delivered under Section 7.
Expiry Dating. All Products shipped to Purchaser, at the time of shipment by Seller, shall have expiry dating which is no more than [**] ([**]) months into the specified expiry schedule for such Product; provided, however, that (i) in no event shall any Product be shipped with less than [**] ([**]) months remaining until its expiry date. Seller shall use reasonable efforts to ship Product to Purchaser with at least [**] ([**]) months remaining until its expiry date.
Expiry Dating. All Product shipped to Sandoz will have expiration dating of no less than [**] months remaining at the time of shipment by Innovator to Sandoz (or its designee). Innovator will use Commercially Reasonable efforts to supply Product with up to [**] months expiration dating. Innovator may request to ship specific lots to Sandoz with less than [**] months dating, but only with the prior written approval of Sandoz.
Expiry Dating. Subject to the issue and availability of the export certification from applicable authorities, Biozyme shall ensure that all Quality Control Product samples with respect to each batch of Product shipped to ISTA, at the time of shipment by Biozyme, shall have expiry dating which is no more than ten (10) business days into the expiry schedule for such Product as specified in its New Drug Application as filed by ISTA with the FDA.
Expiry Dating. Except for Products which comprise the Existing Inventory which are addressed in Section 2.2.4, all Products shipped to Purchaser, at the time of shipment by Seller, shall have no less than [ ** ] months expiry dating remaining for the 2.5mg Product and no less than [ ** ] months expiry dating remaining for the 10mg Product. Purchaser shall notify Seller in the event a Product has [ ** ] months or less dating remaining, and within thirty (30) days of receipt of such notice Purchaser shall deduct from the next quarterly payment owing to Seller [**] percent ([**]%) of the amount actually paid to Seller for such Product. For all deliveries consisting of Existing Inventory, at the time of shipment by Seller, such Products shall have no less than [ ** ] months expiry dating remaining. At Seller’s option and sole expense, Purchaser shall (a) destroy such Product, or (b) return such Product to Seller.
