EXPENSES OF OPERATION. MANAGEMENT AND MAINTENANCE OF THE COMMON AREAS OF THE COMPLEX, PREMISES AND BUILDING IN WHICH THE PREMISES ARE LOCATED. As Additional Rent and in accordance with Paragraph 4(D) of this Lease, Tenant shall pay to Landlord Tenant’s proportionate share (calculated on a square footage or other equitable basis as calculated by Landlord) of all expenses of operation, management, maintenance and repair of the Common Areas of the Complex including, but not limited to, license, permit, management fees (not to exceed 3.0% of the gross rental income of the Complex) and inspection fees; security; utility charges associated with exterior landscaping and lighting (including water and sewer charges); all charges incurred in the maintenance of landscaped areas, lakes, parking lots, sidewalks, driveways; maintenance, repair and replacement of all fixtures and electrical, mechanical and plumbing systems; structural elements and exterior surfaces of the buildings; salaries and employee benefits of personnel and payroll taxes applicable thereto; supplies, materials, equipment and tools; the cost of capital expenditures which have the effect of reducing operating expenses, provided, however, that in the event Landlord makes such capital improvements which exceed Seventy Five Thousand Dollars ($75,000.00), Landlord shall amortize its investment in said improvements (together with interest at the rate of eight (8%) percent per annum on the unamortized balance) as an operating expense over the useful life of the capital improvement in a manner consistent with industry practice. As Additional Rent and in accordance with Paragraph 4(D) of this Lease, Tenant shall pay its proportionate share (calculated on a square footage , or other equitable basis as calculated by Landlord) of the cost of operation (including common utilities), management, maintenance and repair of the Premises and the building (including common areas such as lobbies, restrooms, janitor’s closets, hallways, elevators, mechanical and telephone rooms, stairwells, entrances, spaces above the ceilings) in which the Premises are located. Further, Landlord hereby represents and covenants that with respect to direct maintenance of the Premises only WSJ's overhead shall be included in these costs and no profit component is or will be built into the cost of the services or materials provided by any of Landlord's subsidiaries or affiliates who are under contract to provide services and materials to the Premises (including without limitation WSJ Properties). Excluded as reimbursable costs from Tenant to Landlord are the following:
EXPENSES OF OPERATION. You will pay the ordinary office expenses of the Fund including its rent and will provide investment advisory, research and statistical facilities and all clerical services relating to research, statistical and investment work. You will not be required to pay any expenses of the Fund other than those enumerated in this paragraph 2 and in particular, but without limiting the generality of the foregoing, will not be required to pay brokers' commissions; legal, auditing, and registrar's fees and expenses; taxes and governmental fees; the cost of sale, underwriting, distribution, redemption, transfer or repurchase of shares of the Fund; the expenses of registering or qualifying securities for sale; the cost of preparing and distributing reports and notices to shareholders; or the fees or disbursements of custodians of the Fund's assets including expenses incurred in the performance of any obligations enumerated in the Articles of Organization or Bylaws of the Fund, insofar as they govern agreements with any such custodian.

EXPENSES OF OPERATION. The proper costs and expenses of ECIIB (including those of its agents and including its legal costs and disbursements) attributable to the establishment, financing and operation of the Insolvency Fund Scheme (including sums expended in connection with or in contemplation of litigation relating to Claims and an appropriate proportion of ECIIB's general overhead) shall be payable out of, and shall be a first charge on, the Insolvency Fund and shall be paid in arrears on a monthly basis, provided that nothing in this Agreement shall in any way limit the right of ECIIB to recover from an Insolvent Insurer the full amount of any legal or other costs and expenses that have been charged against the Insolvency Fund in connection with or arising out of that Insurer's Insolvency.

(including those of its agents and including its legal costs and disbursements) attributable to the establishment, financing and operation of the Insolvency Fund Scheme (including an appropriate proportion of M.I.B.'s general overhead) shall be payable out of, and shall be a first charge on, the Insolvency Fund and shall be paid in arrears on a monthly basis, provided that nothing in this Agreement shall in any way limit the right of M.I.B. to recover from an insolvent Insurer the full amount of any legal costs and expenses that have been charged against the Insolvency Fund in connection with or arising out of that Insurer’s insolvency.
