Expenses of Collection. Should this Note be referred to an attorney for collection, whether or not judgment has been confessed or suit has been filed, Borrower shall pay all of Lender's actual costs, fees (including reasonable attorneys' fees) and expenses resulting from such referral.

All amounts payable by Grantor under this Section 5.16 shall be due upon demand and shall be part of the Secured Obligations. Grantor's obligations under this Section shall survive the termination of this Deed to Secure Debt and the discharge of Grantor's other obligations hereunder.
Expenses of Collection. All costs, expenses and liabilities incurred by Bank in collecting or attempting to collect on the Term Note, including costs and expenses incurred in proposing or selling or otherwise deriving upon any security, and all reasonable attorneys' fees in connection with such matters, shall constitute a demand obligation of the Company and shall bear interest from the date of expenditure until paid at the per annum rate of three percent (3%) in excess of the Prime Rate.

Upon a default by Inland under this Note, Inland shall pay all of the Holder's reasonable costs, fees, and expenses in connection with the enforcement or collection of this Note, including attorneys' fees and related legal and court costs, whether or not judgment has been confessed, suit has been filed, or any other action has been commenced by or on behalf of the Holder to enforce or collect this Note, all of which shall be added to and become part of the debt evidenced hereby, and shall bear interest at the Default Rate.
