Exercise of Professional Judgment. Health Plan shall neither dictate nor direct Practitioner in his/her health care practice or the exercise of professional judgment, nor shall Practitioner or Provider hinder Health Plan in the conduct of its business. Health Plan's quality management and medical management activities and designation of exclusive or preferred Affiliated Providers shall not be construed as a violation of this provision.

Exercise of Professional Judgment. Nothing in the Clinical Model shall be interpreted to interfere in any manner with the exercise of Provider’s professional judgment.
