Exercise of Functions. Notwithstanding anything to the contrary contained in this Agreement, nothing contained in this Agreement shall in any way estop, limit or impair the City from exercising or performing any regulatory, policing, legislative governmental or other powers and functions with respect to the Property pursuant to applicable law.
Exercise of Functions. The rights of the Corporation as provided in this Agreement may be exercised on behalf of the Corporation only by the Board (excluding you).

Exercise of Functions. 3.1 In exercising the Functions, each Borough/District Council hereby agrees with the County Council to discharge the Functions in its Area in accordance with the Policy and to have regard to and comply with all statutory and legislative requirements associated with the Functions. 3.2 The County Council may only alter the full and/or discounted monetary amount of on-street Penalty Charges within any Borough/District Council’s Area following consultation with the Borough/District Council in question and subject, where necessary, to the approval of the Secretary of State. 3.3 The County Council shall retain the right to introduce or change on street paid for parking charging and to approve the level of on-street paid for parking charges including residents’ and other parking permits PROVIDED THAT the County Council will consult the appropriate Borough/District Council in writing of such proposals in advance and, before implementing such proposals, shall consider any response received in writing within 30 days of the date of such notification by the County Council to the Borough/District Council. 3.4 If any Borough/District Council wishes to make any change in the management of its off-street car parks, including any adjustment by notice or otherwise to the level of parking charges in any off-street car park, it may do so PROVIDED THAT the Borough/District Council will consult the County Council in writing of its proposals in advance and, before implementing such proposals, shall consider any response received in writing within 30 days of the date of such notification by any Borough/District Council to the County Council.

Exercise of Functions. 3.1 Trafford, subject to the provisions of this Agreement and subject to Schedule 3, hereby authorises Manchester to exercise all of its functions as Highway insofar as is required for the purposes of the carrying out of the Project in accordance with the Design and with the terms of reference agreed by the Project Board 3.2 Manchester agrees to carry out the Project in accordance with the terms of this Agreement and the Design and the terms of reference agreed by the Project Board and subject to Schedule 3.
Exercise of Functions. 6.1 In exercising any Functions under this Agreement both parties shall carry out the same efficiently and with all due diligence and skill in accordance with the Contract Standards, included in Schedule 2. 6.2 The District Council may in consultation with the Borough Council and by three months written notice to the Borough Council withdraw or add to any off street Parking Places or Parking Bays within Parking Places for the operation of the Functions under this Agreement.6.3 Subject to the provisions of Sections 35(C), 39, and 46A of the 1984 Act the District Council shall retain the right to determine in accordance with any legislation applicable from time to time: 6.3.1 Provision for traffic regulation orders as set out in Section 35(1) of the Road Traffic Regulation Act 1984 including but not limited to : 6.3.2 the level of charges for use of and in connection with the Parking Places; 6.3.3 the vehicles or classes of vehicles entitled to use the Parking Places; and 6.3.4 the conditions on which the Parking Places may be used; including the days and hours of operation and maximum periods for which vehicles may wait inthe Parking Places. 6.4 The Borough Council will inform the District Council of any changes in the pricing information on the operation of the Agreement. The level of costs to be charged and estimated income received by each party is included in Schedule 4 of this Agreement.
