Exempt Employee. An employee who is not subject to the minimum wage and overtime provisions of the federal FLSA. Employees may be exempt under one or a combination of the tests defined in the FLSA which include: Executive Test - Employees who supervise at least two (2) full-time employees (or the part-time equivalent); exercise discretion such as scheduling employees, assigning work and financial planning; effectively recommend or have authority to hire, fire, promote and approve pay increases; and have supervision and management as their primary duty.
