The excussion clause establishes that a creditor must first attempt to recover a debt from the principal debtor before seeking payment from a guarantor or surety. In practice, this means that if a borrower defaults, the lender is required to exhaust all reasonable remedies against the borrower’s assets before turning to the guarantor for satisfaction of the debt. This clause primarily serves to protect guarantors by ensuring they are only called upon as a last resort, thereby allocating risk more fairly and preventing premature or unnecessary claims against them.
