Common use of Excusable Delays Clause in Contracts

Excusable Delays. Neither party shall be responsible for delays or lack of performance resulting from acts beyond the reasonable control of the party or parties. Such acts shall include, but not be limited to, acts of God, fire, strikes, material shortages, compliance with laws or regulations, riots, acts of war, or any other conditions beyond the reasonable control of a party.

Excusable Delays. Neither party shall be held responsible for delays or lack of performance resulting from caused by acts beyond the reasonable control of the party or parties. Such acts shall includeits control, but not be limited to, such as acts of GodGod or public enemies, firegovernment acts, strikesutility or communications delays or failures, material shortages, compliance with laws or regulations, riots, acts of warlabor disputes, or any other conditions beyond the reasonable control of a partywar.

Neither party shall be responsible liable to the other for delays any delay or lack of performance resulting from acts failure to perform hereunder (excluding payment obligations) due to circumstances beyond the such party's reasonable control of the party or parties. Such acts shall includecontrol, but not be limited to, including acts of God, acts of government, flood, fire, strikesearthquakes, material shortages, compliance with laws or regulations, riotscivil unrest, acts of warterror, strikes or any other conditions beyond the labor problems (excluding those involving such party's employees), service disruptions involving hardware, software or power systems not within such party's reasonable control control, and denial of a partyservice attacks.

Excusable Delays. Neither party shall be responsible for delays or lack of performance resulting from acts beyond the reasonable control of the party or partiesparties (except that a force majeure shall not excuse City’s obligation to pay). Such acts shall include, but not be limited to, acts of God, fire, flood, earthquakes, pandemics, epidemics, strikes, labor shortages, labor disputes, material shortages, communications or power grid disruption, compliance with laws or regulations, riots, acts of war, acts of the government, or any other conditions beyond the reasonable control of a party.

Excusable Delays. Neither party shall be held responsible for delays caused by acts beyond its control, such as acts of God or public enemies, government acts, utility or communications delays or failures, accidents not caused by its own negligence or fault, labor disputes, war, or failure of the other party to provide required data. Seller shall be responsible for delays and restrictions caused by its personnel's failure to comply with the terms of this Agreement, resulting in exclusion from facilities or lack of performance resulting from acts beyond the reasonable control of the party access to Confidential Information or parties. Such acts shall include, but not be limited to, acts of God, fire, strikes, material shortages, compliance with laws or regulations, riots, acts of war, or any other conditions beyond the reasonable control of a partysystems.

Excusable Delays. Such acts shall includecontrol, including but not be limited toto an act of God, acts or omissions by the other party, acts of Godcivil or military authority, fire, strikes, material shortages, compliance with changes in relevant laws or regulations, riots, acts of warregulations governing either party, or any other conditions beyond the reasonable control of a partylabor or transportation problems.
