Common use of Exclusivity Agreement Clause in Contracts

Exclusivity Agreement. Notwithstanding any provision contained in the --------------------- Exclusivity Agreement dated as of July 1, 1998 between the parties hereto to the contrary (the "Exclusivity Agreement") the Exclusivity Period (as defined in the Exclusivity Agreement) and the termination date provided in Section 6 thereof, shall each be extended to September 30, 1998 or the Closing Date, whichever occurs first.
