Common use of Exclusion of Other Remedies Clause in Contracts

Exclusion of Other Remedies. No Party shall have the right to bring any proceeding against any other Party for a breach of any representation, warranty, covenant or agreement contained in this Agreement, except for a proceeding brought in accordance with the provisions of this Article and Article 10 hereof. This provision is not intended to preclude any proceeding by any Party against any other Party based on a cause of action or right, including any statutory right, other than a cause of action in contract or tort for breach of a representation, warranty or agreement contained in this Agreement.
