Common use of Excluded Scope Clause in Contracts

Excluded Scope. It is understood that Honeywell’s repair, replacement, and emergency service obligations apply only to the Covered Equipment (and only to the extent expressly provided in the Proposal or Order). Honeywell is not obligated to provide replacement software, equipment, components, and/or parts that represent a betterment or capital improvement to Buyer’s system(s) hereunder. Repair or replacement of non-maintainable parts of the system such as, but not limited to, ductwork, piping, shell and tube (for boilers, evaporators, condensers, and chillers), unit cabinets, boiler refractory material, heat exchangers, insulating material, electrical wiring, hydronic and pneumatic piping, structural supports and other non-moving parts, is not included under this Agreement. Costs to repair or replace such non- maintainable parts will be the sole responsibility of Buyer. Unless explicitly specified, Buyer retains all responsibility for maintaining local area networks, wide area networks, leased lines, and/or other communication mediums incidental or essential to the operation of the system(s) or equipment found included in the Covered Equipment. Honeywell is not responsible for maintaining a supply of, furnishing and/or replacing lost or needed refrigerants not otherwise expressly required under this Agreement. Buyer is solely responsible for the cost of material and labor of any such refrigerant not otherwise provided for under this Agreement at current market rates. Honeywell will not reload software, nor make repairs or replacements necessitated by reason of negligence or misuse of equipment by persons other than Honeywell or its employees, or caused by lightning, electrical storm, or other violent weather or by any other cause beyond Honeywell’s control. Honeywell may provide such services at Buyer’s request and at an additional charge.

Kanal, ▇▇▇▇, kovan ve hortum (kazanlar, buharlaştırıcılar, kondansatörler ve soğutucular için), ünite dolapları, kazan refrakter malzemesi, ısı eşanjörleri, yalıtım malzemesi, elektrik tesisatı, hidronik ve pnömatik borular, yapısal destekler ve diğer hareketli olmayan parçalar gibi, ancak bunlarla sınırlı olmamak üzere, sistemin bakımı yapılamayan parçalarının onarımı veya değiştirilmesi işbu Sözleşme kapsamına dâhil değildir. Bu tür bakımı mümkün olmayan parçaların onarımı veya değiştirilmesine ilişkin masraflar yalnızca Alıcının sorumluluğunda olacaktır. Açıkça belirtilmedikçe, Alıcı, Kapsam Dâhilindeki Ekipmanda bulunan sistemlerin veya ekipmanın çalışması için arızi veya gerekli ▇▇▇▇ yerel ▇▇▇▇ ağlarının, ▇▇▇▇▇ ▇▇▇▇ ağlarının, kiralık hatların ve/veya diğer iletişim ortamlarının bakımı için tüm sorumluluğu elinde tutar. Honeywell, işbu Sözleşme kapsamında aksi açıkça belirtilmedikçe kayıp veya ihtiyaç duyulan soğutucu akışkanların tedarik edilmesinden, sağlanmasından ve/veya değiştirilmesinden sorumlu değildir. Alıcı, işbu Sözleşme kapsamında aksi belirtilmeyen bu tür soğutucu akışkanların malzeme ve işçilik maliyetinden mevcut piyasa fiyatları üzerinden tek başına sorumludur. Honeywell, Honeywell veya çalışanları dışındaki kişiler tarafından ekipmanın kusurlu veya yanlış kullanımı nedeniyle veya yıldırım, elektrik fırtınası veya diğer şiddetli hava koşulları ya da Honeywell'in kontrolü dışındaki herhangi bir nedenden dolayı gerekli ▇▇▇▇ yazılımı
