Common use of Evaluative Material Clause in Contracts

Evaluative Material. A copy of all evaluative material relating to an employee shall be retained in his/her official personnel file in the Human Resources Office. Before evaluative material is placed in the personnel file, a copy of such material shall have previously been made available to the employee. The employee shall have acknowledged receipt of such evaluative material but such acknowledgment shall not signify anything other than receipt of a copy of the material. Should the employee refuse to sign the material, the supervisor shall write on the material that the employee refused to sign, date it and sign his/her name to the material. The employee shall have the right to respond to any material placed in his/her file by submitting the response in writing within ten (10) working days of the filing of the original material. Such response shall be attached to the file copy.

Such response shall be attached to the file copy.
