Ethnic Minorities. 50. In case that any ethnic minorities in the Project areas would be affected by any Subproject, the concerned Local Governments and the concerned IA(s) shall ensure that (i) an EMDP be prepared according to the requirements of the EMDF; (ii) benefits target ethnic minorities in the Project areas in accordance with ADB's Policy on Indigenous Peoples; (iii) works contract specifications include requirements to comply with EMDF and as a priority provide employment to ethnic minorities; and (iv) adequate staff and resources be committed to supervising and monitoring the implementation of EMDF and progress, if any, be reported to ADB on a semi-annual basis; (v) the EA engage an external independent monitoring agency acceptable to ADB to monitor the implementation of the EMDP semi-annually and submit the monitoring report to ADB; (vi) the statistics of the monitoring data be conducted by gender and the monitoring report and the monitoring data include analysis on social impacts by gender.
Ethnic Minorities. The parties have agreed to work, both centrally and locally, to arrange conditions so that ethnic minority groups will to a greater extent elect to take jobs in industry. For this reason the local parties should therefore discuss enterprise-related problems connected with recruiting minority groups, such as practical arrangements and general attitudes.
Ethnic Minorities. 5. The Recipient shall ensure that Subprojects do not adversely affect ethnic minorities. In particular, the Project shall be carried out in accordance with the ethnic minorities development framework, as agreed between the Recipient and ADB. The Recipient shall ensure that no Subprojects with significant adverse impacts on ethnic minorities are financed under the Project. For Subprojects in which ethnic minorities are present and affected, an ethnic minorities development plan shall be prepared in accordance with the ethnic minorities development framework. The Recipient shall ensure that, measures to improve the welfare of ethnic minorities are built into the overall Subproject design where the indigenous peoples population exceeds 60% and no negative impact on such ethnic minorities is expected.
Ethnic Minorities. 6. The Borrower shall ensure that the Project does not have any adverse impact on the livelihood of ethnic minorities living in the project area. In the event of any unforeseen impact on the livelihood of ethnic minorities, (i) the Borrower shall inform ADB of such situation and prepare an ethnic minority development plan in accordance with Xxxxxxxx's relevant laws and regulations, and ADB’s Policy on Indigenous Peoples (1998); and (ii) the Borrower shall not give a notice to proceed to a civil works contractor until ADB has reviewed and approved such plan.
Ethnic Minorities. 14. The Recipient shall ensure that the Project does not have any adverse impact on the livelihood of nomadic herders and ethnic minorities living in the Project area. In the event of any unforeseen impact on the livelihood of nomadic herders and ethnic minorities, (i) the Recipient shall inform ADB and prepare a plan according to relevant laws and regulations, and ADB’s Policy on Indigenous Peoples (1998); and (ii) Works shall not start until ADB has reviewed and approved the said plan.
Ethnic Minorities. 11. FMG shall, and shall cause FCTG to, ensure that the preparation, design, construction, implementation and operation of the Fangchenggang Site complies with (a) all applicable laws and regulations of the Borrower relating to indigenous peoples; (b) the Indigenous Peoples Safeguards; and (c) all measures and requirements set forth in the EMDP, and any corrective or preventative actions (i) set forth in a Safeguards Monitoring Report; or
Ethnic Minorities. 13. The Borrower shall ensure, or cause UCSA to ensure, that the Project does not have any impact on Indigenous Peoples (ethnic minorities) within the meaning of the SPS. If any impact on ethnic minorities is identified during the planning, design or implementation of the Project, the Borrower shall ensure that such preparation, design, construction, implementation and operation of the Project and all Project facilities shall comply with (a) all applicable laws and regulations of the Borrower relating to ethnic minorities; (b) the Ethnic Minorities Safeguards; (c) the EMDF and (d) all measures and requirements set forth in the ethnic minority plan or any corrective or preventative actions set forth in a monitoring report on the implementation of the ethnic minority plan submitted by the Borrower to ADB.
Ethnic Minorities. 20. BMG shall ensure and shall cause BDIG to ensure that the preparation, design, construction, implementation and operation of the Project and all Project facilities comply with

YPDOT and YHAB shall ensure that the Project (including all Subprojects) shall not have adverse impacts on indigenous peoples as determined under the Safeguard Policy Statement and that all Outputs shall be implemented in a culturally appropriate and participatory manner to meet the needs of various peoples of the country. In the event that the Project or any Subproject or activities under any of them are later determined to involve any impacts on indigenous peoples, as determined under the Safeguard Policy Statement, YPDOT and YHAB shall take all steps required to ensure that the Project complies with the applicable laws and regulations of the Borrower and with the Safeguard Policy Statement, including preparation of an EMDP in accordance with the Safeguard Policy Statement and clearance thereof with ADB. The Borrower shall ensure and cause the Project Provinces to ensure that the preparation, design, construction, implementation and operation of the Project, each Subproject and all Project facilities comply with (a) all applicable laws and regulations of the Borrower relating to ethnic minorities; (b) the Indigenous Peoples Safeguards; (c) the EMDF; and (d) all measures and requirements set forth in the respective EMDPs, and any corrective or preventative actions set forth in a Safeguards Monitoring Report.
