Estate for Years Sample Clauses

Estate for Years. The interest of Lessee under this Lease shall be an estate for years and not a usufruct.

Estate for Years. This Lease shall be construed as creating an estate for years.

Estate for Years. The parties hereto intend that there be conveyed to Tenant by this Sublease an estate for years and not a usufruct. 14.p Termination Defined. The words "terminate" or "tennination" as used herein shall refer to the end of this Sublease due to the ending of this Sublease prior to the expiration of the Term in accordance with the terms and provisions hereof. The parties, however, intend that this Sublease continue in effect and not be terminated or otherwise affected by the doctrine of merger of estates upon the ownership by the same person of both the reversion and the leasehold estate under this Sublease, except as reflected otherwise by such person owning both estates in a wlitten and recorded document consented to by all Leasehold Mortgagees. No cancellation, surrender or modification of this Sublease by the mutual agreement of Landlord and Tenant shall be effective as to any Leasehold M01tgagee unless such cancellation, surrender or modification is consented to in writing by such Leasehold Mortgagee.

Estate for Years. This Lease creates an estate for years in favor of Lessee in the Premises.

Estate for Years. It is the intent of Lessor and Lessee that this Lease shall grant and convey to Lessee and Estate for Years expiring on December 31, 2002, and not a usafruct. Lessee shall be permitted to grant its lenders and any holder of security interest in power generation facility being constructed by Lessee on Lessee's land in Land Lots 236 and 237 of the 3rd Land District of Heard County, Georgia (all of the foregoing being hereinafter collectively referred to as "Lenders"), a leasehold deed to secure debt encumbering the Estate for Years conveyed to Lessee hereunder.
